RECOMMENDATION: It is respectfully recommended: 1. That this report be received; and, That the Town purchase the property described as Part 2, Plan 1OR -1711, Lot 3, Concession 5, former Clarke Township; and, 3. That the Mayor and Clerk be authorized to complete the transaction on behalf of the Town; and, That the subject property be dedicated as public road allowance. ...2 Pv CC age 2 REPORT NO.: WD-22-84 BACKGROUND AND REPORT: Early in 1980, the owners of Part Lot 3, Concession 5, former Clarke, on application for property access, were advised that the Town was interested in acquiring approximately twenty-three (23) feet of property for the purpose of widening and improving the forced portion of Concession Road 6. In 1982, the property changed hands and the new owners, Mr. & Mrs. Robert MacDonald, knowing of the forced road enquired as to the Town's intentions in this matter. Mr. & Mrs. MacDonald were advised that the requirement for a sixty -six (66) foot road allowance for access was not applicable in the former Township of Clarke and that there would be no impediment in acquiring an access to the subject property from the forced portion of Concession Road 6. The previous dedication of Part 4, Plan 108881, an approximate thirteen (13) foot strip of land on the north side of the forced road, now reduced the Town's requirements to approximately thirteen (13) feet to bring the road allowance up to the standard sixty-six (66) feet. Mr. & Mrs. MacDonald indicated their willingness to sell the portion of land and complete the transaction in order that they may proceed with planning their entrance and the location of their proposed residence. ,..3 Page 3 REPORT NO.: WD -22 -84 The MacDonalds, in discussion with Public Works Staff, have completed an offer to sell. Public Works Staff feel it is a good opportunity to acquire the land as the acquisition will assist the department in performing roadside maintenance activities. The area of land is .214 acres and the offer to sell is evaluated at approximately $600.00. Council's favourable acceptance of this report will enable the transaction to proceed. Subsequently, all costs incurred would be charged to the appropriate 1984 Public Works Budget Accounts. Respectfully submitted, R.G. Dupuis, P. Eng., Director of Public Works.
