That Report CS -69 -86 be received; and 2. That the proposed amendments to the Durham Regional Official Plan and the Town of Newcastle Official Plan be referred to Staff for processing and Public Hearings; and 3. That the proposed amendment to By -Law 79 -69 included herein as attachment #3 be approved; and 4. That the proposed amendments to the Town of Newcastle's standard form of Subdivision Agreement including the Parkland Development Specifications be endorsed; and 5. That the 1987 Capital Parks Budget included herein as attachment #7 be approved in principle and referred to the 1987 Budget deliberations. REPORT NO. CS -69 -86 BACKGROUND AND COMMENTS: Page 2. The following resolution was passed by Council May 7, 1986: Resolution C- 426 -86 Moved by Councillor Stapleton, seconded by Councillor Wotten 1. That Report NCSPB -03 -86 be received; and 2. That Council adopt the amended role of the Newcastle Community Services Planning Board as attached; and 3. That a Joint Committee be formed of Council, staff and the NCSPB to review the policy of parkland including size and facilities, area of service and priorate community needs in the Town of Newcastle; resulting in an orderly time table for development of said facilities; and Resolution C- 427 -86 Moved by Councillor Hamre, seconded by Councillor Wotten THAT Resolution C- 427 -86 be amended by adding the following: 3b) That Council appoint the Chairman of Community Services and the Chairman of Planning to sit on the Joint Committee to review the policy on Parkland. "CARRIED" As a result of the above the Parks Policy Sub - Committee, herein referred to as the sub - committee, was formed consisting of Chairman, Milt Dakin, NCSAB, Noel River, NCSAB, Councillor Marie Hubbard, Councillor Frank Stapleton and staff members Terry Edwards and Jan Devantier. The sub - committee has met formally approximately once per month since its inception. After the first exploratory meetings the following Terms of Reference for the sub - committee was established based on the above resolution: Responsibilities 1) To review existing policies on parkland including: a) Durham Regional and Town of Newcastle Official Plans b) Open Space Policy By -Law 79 -69 c) Subdivision Agreement - Park Development section d) Specifications for Development of Open Space e) Master Plan - Open Space Standards 2) Revise consolidate and /or update the above policies as required. 3) After 2) consolidate all parkland policies into one policy to be included in the revised Master Plan. ../3 65, (C) REPORT NO. CS -69 -86 Page 3. 4) Review and document current inventory of parkland, parkland facilities and equipment and open space. 5) Priorize parkland acquisition and development for the 1987 Capital Budget. 6) Priorize parkland acquisition and development for the 1988 -91 Capital Budgets. 7) In conjunction with School Board representatives,review and update current joint use agreements and policies. 8) Review current service and maintenance levels of all parks and establish standards. 9) Establish a parks maintenance management system. Critical Path As per the resolution the sub - committee set its target for the first interm report prior to the 1987 budget deliberations. REPORT This first interm report will deal with the sub - committee findings and recommendations on the following sections of its responsibilities above: a) The proposed amendments to the Durham Regional Official Plan and the Newcastle Official Plan; b) The proposed amendments to By -law 79 -69; c) The proposed amendments to the town of Newcastle's standard form of subdivision agreement; d) The proposed new Park Site Master Plan Specifications; e) The proposed priorized parkland acquisition and development for the 1987 Capital Budget. The review and documentation of the current inventory of parkland, parkland facilities and equipment and open space has been ongoing by the Committee and will form part of the final report. It is the sub - committee's recommendation that this updated inventory be included in the proposed revised Culture and Recreation Master Plan scheduled for completion in 1987 -88. ../4 REPORT NO. CS -69 -86 Page 4. The remainder of the sub - committee's responsibilities are scheduled to be addressed in the next interm report, early in 1987. Proposed Amendments to Current Policies Arising from the review conducted by the Parks Policy Sub - Committee, a number of policy questions were raised which, in the Sub - Committee's opinion, should be addressed through amendments to various Planning documents in order to further clarify and reinforce the objectives of the Town with respect to the provision of Public Open Space. The Sub - Committee's review considered the Durham Regional Official Plan and the town of Newcastle Official Plan, the Town's Policy in respect of parkland dedications as spelt out by By -law 79 -69, and the Town's standard Subdivision Agreement. Attachments 1 through 5 inclusive, detail the form of the proposed amendments which the Sub - Committee recommends for Council's consideration. The following comments are provided in order to give a general overview of the intent of each of these amendments. Durham Regional Official Plan As presently written, the Durham Regional Official Plan establishes standards for the provision of parkland of 5 acres per 1,000 persons for local parks, and 2 acres per 1,000 persons for larger parks. Inasmuch as a typical parkland dedication based upon 5% of the developable land of a subdivision is roughly equivalent to 2.5 acres per 1,000 persons, the standards as set out in the Regional Plan would place the onus on the local municipality to make up the deficiency. The Town's Culture and Recreation Master Plan identifies a much lower standard; that being 2 acres per 1,000 persons for local parks and 1.5 acres per 1,000 persons for larger community parks. The proposed amendment would eliminate from the Regional Official Plan, specific reference to parkland standards and allow the Council of a local municipality to establish its own standards within its local Official Plan. ../5 REPORT NO. CS -69 -86 Town of Newcastle Official Plan `f 6 Page 5. The Town's Official Plan presently provides very detailed requirements for the provision of the parkland, however, through the review of these policies, it was felt that certain provisions of the Plan should be reinforced and the intent redefined through minor amendments. For each of the Urban Areas, these amendments include establishing a minimum size for neighbourhood parks of 3 hectares. Presently in Newcastle Village and Courtice, the Official Plan requires only 2 hectares, and specifies the Town's standard for the provision of local parkland. The amendments also provide flexibility to the municipality and accepting smaller parks after considering the location of the park and its relationship to other Open Space opportunities within the immediate neighbourhood. The provisions of the Official Plan are further amended by establishing the parkland standard for Community Parks and providing a policy statement with respect to the provision of parkettes. It has also been proposed that, consistent with the practice of the Town relative to the acquisition of valley lands, that in the Urban Areas the specific creek systems which may be appropriate for public acquisition, are identified by name along with a clear indication that it is the intent of the Town of Newcastle to have these areas developed for passive recreational purposes. With respect to rural areas of the Town, it was felt that some direction should be provided relative to the Town's intentions; accordingly, the Official Plan is proposed to be amended by adding, under the Hamlet section, a statement of provision of community parks and identifying the Hamlets within which community parks, of not less than 4 hectares each, would be provided. Once entrenched within the Official Plan, 'the expenditure of public funds on a community park within a Hamlet not identified by the Plan would require an Official Plan Amendment, thus requiring proponents of any proposed community park to fully justify the need for such a facility. Inasmuch as the foregoing recommendations deal with Official Plan policy, it is necessary for the Town to proceed in accordance with the requirements of the Planning Act. Accordingly, it is the Sub - Committee's recommendation that the attachment Official Plan amendments be initiated by Staff and the necessary public hearings scheduled for early in 1987. ../6 REPORT NO. CS -69 -86 Page 6. In the short term, there are other amendments to Town Policy which can be amended forthwith in order to formalize certain practices of the Town with respect to the provision of public Open Space. In this regard, it is being suggested that, By -law 79 -69 of the Town of Newcastle be amended to identify, by name, the valley lands within the Urban Areas which the Town will be seeking gratuitous dedication of as a condition of development approvals. It is recommended that this amendment be implemented through approval of the By -law included as Attachment 3 hereto. The other area which can receive immediate attention is with respect to the Town's requirements of subdivider's as dictated through the terms of our standard form of Subdivision Agreement. Although the proposed inclusions are currently being utilized, where appropriate, it is felt that they should be fully endorsed by Council in order to ensure that they accurately reflect the wishes of Council relative to developer's contributions. As indicated by Attachment 4, developers would be required to prepare Master Park Site plans identifying all existing and proposed grades, as well as location of all future playing fields, park furniture, walkways, etc. These plans would have to be approved by the Directors of Public Works, Planning and Community Services prior to commencement of the works, and the developer would be required to complete installation of the park in accordance with the plans prior to the issuance of the building permit representing 25% of the total number of units within the Plan. In the event of winter construction, the work would have to be completed by June 30 of the year following. More detailed specifications have been added as Attachment 5 hereto to give developers clear specifications for work required under the proposed revised Subdivision Agreements. Proposed 1987 Parks Capital Budget After an extensive review of the parkland inventory in the Town of Newcastle the Sub - Committee identified four major areas of parkland deficiency: Newtonville Enniskillen Bowmanville (Waverly /Martin Road area) Courtice ../7 6- 01, 1 REPORT NO. CS -69 -86 Page 7. The Sub - Committee has recognized significant deficiencies throughout the Municipality and urges Council to proceed with the planned improvements. Attachment 6 gives a summary review of all parks /proposed parks in our Municipality and identifies the proposed budget year for development. Attachment 7 gives Council specific details and costs for projects proposed for the 1987 Capital Budget. The work load to accomplish these projects will be significant; however the Sub - Committee feels these projects are long overdue and must be accomplished as outlined. The reserve funds available for these projects include parkland cash -in -lieu and lot levys. There are currently sufficient funds in these accounts to address all the projects proposed (see attachment fa). The Sub - Committee recommends that Council endorse the proposed 1987 Capital Parks projects and direct said budget to budget deliberations. SUMMARY In summary I wish to commend Sub- Committee members for the effort they have put forward to -date on this project and I feel the resolution statement "resulting in an orderly time table for development of said facilities" is closer than ever to being real i ty . Respectfully submitted, C � L-- Milt Dakin, Chairman (on behalf of the Parks Policy Sub - Committee) MD:sa Recommended for presentation Chief Administrative Officer ATTACHMENT NO. 1 PARKS POLICY SUB - COMMITTEE PROPOSED AMENDMENTS TO OFFICIAL PLANS DEALING WITH PARKS POLICY AMENDMENT NO. 1 - DURHAM REGIONAL OFFICIAL PLAN The purpose of the proposed amendment is to eliminate reference to specific area to population ratios. BASIS: The basis of the proposed amendment is the fact that the Regional Plan currently requires that local parks be provided on the basis of 5 acres per 1000 population and larger parks at a ratio of 2 acres per 1000 population. The Town of Newcastle, through its Culture and Recreation Master Plan, has determined that an appropriate standard for local parks is 2 acres per 1000 population and for larger parks, 1.5 acres per 1000 population. As it presently exists, the Regional Official Plan would place, upon the Municipality, an undue burden for acquiring additional parkland above and beyond that which can be reasonably received through parkland dedication as required as a condition of development approvals. ACTUAL AMENDMENT: Section 8.1.2.10 of the Durham Regional Official Plan is hereby amended to read as follows: "It is the intention of the Plan to encourage the provision of local parks and large urban parks. Councils of the respective area municipalities may adopt Open Space Standards and shall stipulate such standards within a District Plan after due consideration by the Council of the respective area municipality and concluded to be appropriate." ATTACHMENT NO. 2 AMENDMENTS TO THE TOWN OF NEWCASTLE OFFICIAL PLAN The purpose of the proposed amendment is to more clearly define Parks and Open Space standards for the Town of Newcastle. BASIS: The basis of the proposed amendment is found in the Town of Newcastle Culture and Recreation Master Plan and the recommendations of the Parks Policy Technical Committee charged with the responsibility of reviewing existing Town of Newcastle Parks Policy in consideration of the recommendation of the Town of Newcastle Recreation and Open Space Master Plan. ACTUAL AMENDMENT: The Town of Newcastle Official Plan is hereby amended as follows: (1) Section 6.3.2(iii)(a) is hereby amended to read as follows: "Neighbourhood parks shall not normally be less than 3 hectares in size and shall be provided on the basis of 0.8 hectares per 1000 persons population." (2) Section 6.3.2(iii)(c) is hereby amended to read as follows: "Neighbourhood parks smaller than the minimum size may be permitted by Council without amendment to the Plan after consideration of the size of the park relative to others in the neighbourhood, the amounts of parkland already committed for park purposes, the physical nature of the lands in question, and its relationship to other Open Space opportunities such as valley lands and school sites." (3) Section 6.3.2(iv)(b) is hereby amended to read as follows: "Community parks shall not be less than 8 hectares in size and shall be provided on the basis of 0.6 hectares per 1000 persons population." (4) Section 6.3.2 is hereby further amended by adding thereto the following new Subsection (v) Parkettes: "(v) Parkettes Parkettes may be provided without an amendment to this Plan where there appear to be physical barriers such as arterial or collector roads and /or watercourses which may prevent pedestrian access for young children to a Neighbourhood or Community Park." ../2 AMENDMENTS TO THE TOWN OF NEWCASTLE OFFICIAL PLAN ACTUAL AMENDMENT: (Cont'd) (5) Section 6.3.2(ii)(a) is hereby amended to read as follows: Page 2. "The Major Open Space System within the Courtice Major Urban Area comprises those lands below the topographic break in slope of the Black and Farewell Creek system. The boundaries of the Major Open Space System shown on Schedule 1 are not precise and shall only be used as guidelines. More precise boundaries may be delineated in Neighbourhood Development Plans and the restricted area zoning by -law in consultation with the Central Lake Ontario Conservation Authority and the Ministry of Natural Resources. Council shall encourage public acquisition of and access to, for passive recreational purposes, the valley lands of the Black and Farewell Creek systems." (6) Section 7.3.2(ii)(a) is hereby amended to read as follows: "Major Open Space within the Bowmanville Major Urban Area generally comprises those lands below the topographic break in slope of the valley lands associated with the Bowmanville and Soper Creek systems. The boundaries of the Major Open Space areas shown on Schedule 1 are not precise and shall only be used as guidelines. More precise boundaries shall be delineated in the Zoning By -law in consultation with the Central Lake Ontario Conservation Authority and the Ministry of Natural Resources. Council shall encourage the public acquisition of and access to, for passive recreational purposes, the valley lands of the Bowmanville and Soper Creek systems." (7) Section 7.3.2(iv)(b) is hereby amended to read as follows: "Community Parks shall not be less than 8 hectares in size and shall be provided on the basis of 0.6 hectares per 1000 persons population." (8) Section 7.3.2(v)(b) is hereby amended to read as follows: "Neighbourhood Parks shall not normally be less than 3 hectares in size. The size and shape of the park shall permit the development of an appropriate range of active recreational facilities to the satisfaction of Council. Neighbourhood Parks shall be provided on the basis of 0.8 hectares per 1000 persons population." (9) Section 7.3.2(v)(c) is hereby amended to read as follows: "Neighbourhood Parks smaller than the minimum size may be permitted by Council without amendment to this Official Plan after consideration of, the size of park relative to others within the neighbourhood, the amount of parkland already committed for park purposes, the physical nature of the lands in question, and the proximity of the park relative to other Open Space opportunities such as valley lands and school sites. ../3 AMENDMENTS TO THE TOWN OF NEWCASTLE OFFICIAL PLAN Page 3. ACTUAL AMENDMENT: (Cont'd) (10) Section 7.3.2 is hereby further amended by adding thereto the following new Subsection (vi): "(vi) Parkettes Parkettes may be provided without an amendment to this Plan where there appear to be physical barriers such as arterial or collector roads and /or watercourses which may prevent pedestrian access for young children to a Neighbourhood or Community Park." (11) Section 8.3.2(ii)(a) is hereby amended to read as follows: "Major Open Space within the Newcastle Village Small Urban Area generally comprises those lands below the topographic break and slope top of bank of the valley lands associated with the Graham and Foster Creek system, as well as lands directly related to the Lake Ontario Waterfront. The boundaries of the Major Open Space areas shown on Schedule 1 are not precise and shall only be used as guidelines. More precise boundaries shall be delineated in the Zoning By -law in consultation with the Ganaraska Region Conservation Authority and the Ministry of Natural Resources. Council shall encourage the public acquisition of and access to for the purposes of passive recreation activities in the valley lands of the Graham and Foster Creek systems and the Lake Ontario Waterfront." (12) Section 8.3.2(iv)(b) is hereby amended to read as follows: "Community parks shall not be less than 8 hectares in size and shall be provided on the basis of 0.6 hectares per 1000 persons population." (13) Section 8.3.2(v)(b) is hereby amended to read as follows: "Neighbourhood Parks shall not normally be less than 3 hectares per 1000 persons population. The size and shape of the park shall permit the development of an appropriate range of active recreational facilities to the satisfaction of Council." ACTUAL AMENDMENT: (Cont'd) (15) Section 8.3.2 is hereby further amended by adding thereto the following new subsection (vi): "(vi) Parkettes Parkettes may be provided without an amendment to this Plan where there appear to be physical barriers such as arterial or collector roads and /or watercourses which may prevent pedestrian access for young children to a Neighbourhood or Community Park." (16) Section 9.5 is hereby amended by adding thereto the following new Subsection(ii): "(ii) COMMUNITY PARKS (a) Community Parks shall be provided in the Hamlets of Burketon, Enniskillen, Hampton, Kendal, Orono, Mitchells Corners, Newtonville, Solina and Tyrone. (b) Community Parks shall not be less than 4 hectares in size and shall be provided on the basis of 0.6 hectares per 1000 persons population served. (c) Notwithstanding (b) above Community Parks smaller than the minimum size may be permitted by Council without amendment to this Official Plan after consideration of the size of the park relative to others within the haml et." ATTACHMENT NO. 3 BY -LAW NO. Being a By -law to amend By -law 79 -69 of the Town of Newcastle in respect of Parkland Dedications; WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By -law 79 -69; NOW THEREFORE BE IT RESOLVED THAT By -law 79 -69 is amended as follows: (1) Paragraph 2 of By -law 79 -69 is hereby amended to read as follows: "Notwithstanding the above requirements, the Town shall require the gratuitous dedication of the valley lands associated with the Black and Farewell Creek systems in the Courtice Urban Area, the Bowmanville and Soper Creek systems in the Bowmanville Urban Area, and the Foster and Graham Creek systems in the Newcastle Village Urban Area. The Town may also require the gratuitous dedication of flood susceptible lands or lands with hazardous characteristics to the Municipality or appropriate Conservation Authority as a condition of development approval where such dedication is consistent with the objectives and long term goals of such Conservation Authority." A R ERK _. , V ,.,./ ATTACHMENT NO. 4 AMENDMENTS TO THE TOWN'S STANDARD FORM OF SUBDIVISION AGREEMENT As a result of the Technical Committee's review, it is proposed that where a park site is located entirely or partially within a Plan of Subdivision, the developer would be responsible for certain additional works. In that regard, and in such instances, the following amendments to the Subdivision Agreement would be applied: "Paragraph 4.9(1) The Owner shall, prior to any authorization to commence works, prepare and submit for the approval of the Town, complete site plans for all park and open space blocks within the Plan and adjacent lands where required by the Town. Said plans are hereinafter referred to as the "Park Site Master Plan" and shall show thereon the following information: (1) the existing and proposed grades; (2) The location of all future park furniture, signage, sports fields, walkways, lighting and fencing, as well as related details for each of the foregoing. Paragraph 5.10(10) The Owner has received written approval of the Directors of Public Works, Planning and Community Services of the landscape plans and Park Site Master Plans as required by Paragraph 4.9 and as part of the works, more particularly referred to in Schedule "G ". Schedule "G ", Subsection 9 The Owner agrees that, prior to the issuance of the building permit representing 25% of the total number of units within the Plan, to supply and install, in accordance with the town's specifications and the approved Park Site Master Plan, the following facilities: (1) grading and sodding of the park and open space blocks; (2) 100% of the vegetative planting; (3) all walkways; (4) water and sewer connections to property line; (5) fencing; and (6) signage. The Town agrees that in the event that such application for building permit and commencement of construction of said building is made after December 1 of a given year, the foregoing work shall be completed by June 30 of the following year. In all other instances, the work must be completed prior to issuance of such permit." ATTACHMENT NO. 5 APPENDIX TO SUBDIVISION AGREEMENTS PARKLAND DEVELOPMENT SPECIFICATIONS Were a park site is located entirely or partially within a Plan of Subdivision, the owner or developer shall be responsible for certain additional works over and above the 5% parkland dedication and lot levies. A. Park Site Master Plan The owner shall, prior to any authorization to commence works, prepare and submit, for the approval of the Town, complete site plans for all park and open space blocks within the Plan and adjacent lands or adjacent school site lands where required by the Town. Said plans are hereinafter referred to as the Park Site Master Plan and shall show there on the following information: i) the existing and the proposed grades ii) the location of all future park furniture, signage, sports fields, walkways, lighting, services, vegetative plantings and fencing iii) detailed drawings of the above where appropriate. The Town shall be supplied with one colored print of the site design concept, one site design concept in mylar, reduced to 8 112" x 11" and three prints of all mylar drawings. The Owner shall receive written approval from the Directors of Public Works, Planning and Community Services (and if necessary the Boards of Education) on the Park Site Master Plan prior to commencement of works. The owner shall engage a landscape architect or designer. This architect shall be a member in good standing of any of the following (to complete the Park Site Master Plan): i) Ontario Association of Landscape Architects ii) Canadian Society of Landscape Architects iii) American Society of Landscape Architects B Development Specifications The Owner is required to provide and carry out the following items at no cost to the Town, in accordance with the above approved Park Site Master Plan unless otherwise specified. The developer shall complete the following conditions prior to the issuance of the building permit representing 25% of the total number of units within the Plan. The Town agrees that in the event that such application for building permit and commencement of construction of said building is made after December 1 of a given year, the foregoing work shall be completed by June 30 of the following year. In all other instances, the work must be completed prior to issuance of such permit." ../2 �. 5— 00 APPENDIX TO SUBDIVISION AGREEMENTS PARKLAND DEVELOPMENT SPECIFICATIONS CONTINUED... Page 2. B Development Specifications Continued... 1) Landscaping Grading 'is to be completed to the specifications of the grading plan. Topsoil must be a minimum depth of seven (7) cm. Soding and fertilizing of the total site is required unless otherwise specified by the Community Services Department. Planting material (trees, evergreens and shrubs) shall be installed according to the detailed Park Site Master Plan. NOTE: minimum tree trunk diameter five (5) cm. (15 cm. circumference). 2) Paths and Walkways All paths and wal ways are to be interlocking paving stones, asphalt or concrete with a minimum width of two (2) meters and a maximum of three (3) meters. The surface shall be a minimum depth of ten (10) cm. for concrete and seven (7) cm. for asphalt walkways. The base of the path or walkway shall have a minimum of fifteen (15) cm. gravel. 3) Water and Sewer Connections A minimum two 2 inch water line shall be provided to this site. A six (6) inch sewer connection shall be provided to the major park entrance property line. 4) Fencing Vinyl coated 9 gauge chain link fence 1.8 meters high on the perimeter of each open space block and sides of walkways entrances or connecting trails shall be installed unless stipulated otherwise by the Town. 5) Signage Ide— t fication sign for each park site entrance or trail, according to Town standards shall be installed by the Town and the cost borne by the Developer. C Warranty The Developer shall submit to the Director of Community Services, upon satisfactory completion of all work a warranty for the plantings, water supply, paths and sidewalks for one full year from the date of written acceptance of all required works by the Director.
