That report CS -66 -86 be received; and 2. That no employee subject to the Inside /Outside Collective Agreement with C U.P.E. Local 74 shall be laid off work during the period of t-Zme-- -in - -- which the Town participates in the Canada Works Section 38 (5168GK9) program. BACKGROUND AND COMMENTS: As part of the criteria for participating in the Canada Works Section 38 job creation program, Employment and Immigration Canada requires our union's approval of the Town's participation. As such the union has responded and requested that the Town pass a resolution similarly to one passed in 1983 for another project (see attached letter from the Union). Staff have no objection and find it prudent for Council to approve the following resolution: /2 Council Meeting REPORT NO. CS -66 -86 "That no employee subject to the Inside /Outside Collective Agreement with C.U.P.E. Local 74 shall be laid off work during the period of time in which the Town participates in the Canada Works Section 38 (5168GK9) program." Page 2. The other two concerns that the Union has can be addressed directly by staff (refer to Item #1 and Item #3 of the letter). Job Creation Program, and offer the following comments. The Union experienced a similar situation in 1983, when the Town of Newcastle participated in the Canada Community Development program. The resolve at that time was a resolution of Council guaranteeing that, 11 No employee subject to the Inside /Outside Collective Agreement with C.U.P.E. Local 74 shall be laid off work during the period of time in which the Town participates in the Canada Community Development Program or The Canada /Ontario Employment Development Program. 11 The Union's position now is the same as in 1983. I submit a copy of all documents for your perusal pertaining to Grievance 01 -83 filed by the Union, and the final resolve on same. In conclusion, I will set out the Union's terms and conditions as follows, that ; 1. Workers employed under this program are not to be used to perform the work of the Bargaining Unit. They are to be employed only for those tasks as indicated on your report to Council >f CS- 63 -86. 2. This agreement is subject to Council passing a resolution similar to Resolution # GPA- 360 -83 guaranteeing that no employee will be laid off during the period of time of this program. And further that such workers shall not be retained past the specified number of weeks as indicated in your report to Council # CS- 63 -86.
