SUB.ECT: AGREEMENT PERTAINING TO HOUSE LEAGUE HOCKEY
RECOMMENDATIONS:
it is respec fully recommended that the General Purpose and Administration Committee
recommend to Council the following: -
1. That Report CS -46 -86 be received; and
2. That staff and the Mayor be authorized to execute the draft agreement
attached for the former Bowmanville Minor Hockey Association House League
division to assume responsibility for the Recreation Hockey League in the
Town.
BACKGROUND AND COMMENTS:
Through several meetings with the B.M.H.A. Toros and House League Division a draft
agreement for the B.M.H.A. House League to assume responsibility for Recreational
Hockey was developed.
The agreement has been reviewed and approved by the B.M.H.A. House League executive.
(see attached correspondence)
The B.M.H.A. Toro organization has also reviewed the agreement and only had concern
with the name of the new league. (see attached correspondence) Lawyers for the
repective groups agreed that the name Bowmanville Minor Hockey Association House
League Division is indeed in conflicts with the name Bowmanville Minor Hockey
Association as it pertains to incorporation. Based on this judgement the House League
at their last meeting have agreed on the new name Bowmanville Minor Hockey League

Staff wishes to compliment the B.M.H.A. House League for the efficient manner in
which they have operated the house league the past two seasons, and look forward to a
continuous, harmonious working relationship in the future.

to assume the responsibility for "Recreation Hockev League ".
Having been discussed and approval being passed for
the agreement at our June 12 executive meeting, signing on
behalf of the "League" has been completed.

Dear Jan,
The Bowmanville Minor Hockey Association has had an opportunity
to peruse the proposed agreement between the Corporation of the
Town of Newcastle and the group referred to in the proposed
agreement as "The Bowmanville Minor Hockey Association - House
League Divisiontt.
Bowmanville Minor Hockey Association is the name under which we
as an organization are incorporated therefore we feel very
strongly that no other group use it. We would suggest that the
proposed agreement contain a condition making it mandatory for the
House League group to incorporate using a name that does not
include the wording "Bowmanville Minor Hockey Association ".
If this concern is dealt with in a manner that is satisfactory to
us we would be in a position to support the agreement and offer
all possible assistance to the new group.

BETWEEN
AND
The Corporation of the Town of Newcastle hereinafter called the
"Town" of the first part
The Bowmanville Minor Hockey League hereinafter called the "League" of
the second part
WHEREAS The Corporation of the Town of Newcastle and the Bowmanville
Minor Hockey League have agreed to the transfer of the "Recreation
Hockey League" from the Town to the League the parties agree as
follows:
I. The Town through its Community Services Department agree:
a) To transfer all its stock of hockey equipment to the League.
2. The League agrees:
a) To administer and assume responsibility for House League Hockey in
the Town.
b) To administer House League Hockey according to their constitution,
rules and regulations.
c) To provide all personnel required to operate the League ie. coaches,
referees, time keepers.
d) To assume responsibility for all financial transactions of the
League.
e) To incorporate the League and provide adequate insurance for all
personnel involved with the League.
f) To start try -outs for select teams no earlier than after the second
Sunday in October.
g) To accept players cut from the competitive teams up to and including
November 1st of each year.
h) To actively participate in the Hockey Council whose mandate is to
coordinate all hockey in the Town including such issues as
registrations, fund raising and tournaments.
