THAT Report PD-62-94 be received; 2 . THAT the Mayor and Clerk be authorized by By-law to execute an amending Subdivision Agreement between Penwest Development Corporation Limited and the Municipality of Clarington to permit the registration of Phase four (4) of Plan of Subdivision 18T- 76011. 3 . THAT the interested parties listed in this report and any ,delegation by advised of Council's decision. 1. APPLICATION DETAILS 1. 1 Applicant: Penwest Development Corporation Limited 1. 2 Agent: Conroy Dowson Planning Consultants Ltd. 1. 3 Subdivision: Draft Plan of Subdivision 18T-76011 conditions of draft approval revised by the Ministry of Municipal Affairs April 15, 1993 . 2 . LOCATION 2 . 1 The subject site is located within part of Lot 9, Concession 1, former Town of Bowmanville on the west side of Mearns Street south of Concession Street. 3 . BACKGROUND 3 . 1 In January 1981, draft approval to Plan of Subdivision 18T-76011 was given by the Minister of Municipal Affairs and Housing. Over time a number of draft approved changes have been processed and 4 PA ER PELA RECYCLE THIS G PRIMED U4 RECYCLED PAPER REPORT NO. : PD-62-94 PAGE 2 approved through the Ministry of Municipal Affairs in consultation with various agencies including the Municipality of Clarington. 3 .2 Staff would note for the Committee's information that the most recent revisions to the conditions of draft approval which occurred in April 1993 , included revisions to the storm water management techniques to be employed within the draft Plan of Subdivision. As a result, the Ministry of Natural Resources and the Central Lake Ontario Conservation Authority requested that the new conditions be incorporated within the text of the Subdivision Agreement. Hence the necessity of amending the Subdivision Agreement to recognize the revised conditions of draft approval. 3 . 3 Penwest Development Corporation Limited has recently indicated a desire to register a fourth phase of development consisting of twenty (20) single family lots. In order to do so, the Subdivision Agreement must be amended to reflect the current conditions of draft approval as requested by the Ministry of Natural Resources and the Central Lake Ontario Conservation Authority. Accordingly, an authorization By-law is required permitting the Mayor and Clerk to execute on behalf of the Municipality, said amending agreement. 3 . 4 Staff would note that the amending Agreement would not jeopardize the requirements or provisions of the existing Subdivision Agreement with respect to the Municipality's interests in the development of the said lands. 4 . RECOMMENDATIONS 4. 1 In consideration of the above comments, Staff would recommend approval of the authorizing by-law to permit Penwest Development Corporation Limited proceed with its latest registration within Plan of Subdivision 18T-76011. �J � J REPORT NO. : PD-62-94 PAGE 3 Respectfully submitted, Reviewed by, Franklin Wu, M.C. M5H 2T2 I i i 4 � 6 THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW NUMBER 94- being a By-law to authorize the entering into of an amending Agreement with Penwest Development Corporation Limited being the Owner of Plan of Subdivision 1 BT-76011 and the Corporation of the Municipality of Clarington in respect of Plan 18T-76011 The Council of the Corporation of the Municipality of Clarington enacts as follows: 1. THAT the Mayor and Clerk are hereby authorized to execute on behalf of the Corporation of the Municipality of Clarington and seal with the Corporation's seal, an amending Agreement between Penwest Development Corporation Limited, being the Owner of Plan of Subdivision 18T-76011 and the said Corporation in respect of Plan of Subdivision 18T-76011. 2. THAT the Mayor and Clerk are hereby authorized to Accept, on behalf of the Municipality, any conveyances of lands required pursuant to the aforesaid Agreement. 3. Schedule "A" attached hereto shall form part of this By-law. BY-LAW read a first time this day of 1994. BY-LAW read a second time this day of 1994.
