SLBJECT:4 REZONING AND SITE PLAN APPLICATION
APPLICANT: DON & SON BUILDING SUPPLY & LUNARO CONSTRUCTION LTD.
PART LOT 19, CONCESSION 2, FORMER TKP. OF DARLINGTON

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-191-88 be received; and
2. THAT the rezoning and site plan application DEV 88-62 submitted by Don & Son
Building Supply Ltd. and Lunaro Construction Ltd. be DENIED as the
application does not conform to the Hamlet Policies of the Durham Region
Official Plan and the proposal would appear to be premature; and
3. THAT the applicant be advised of Council's decision.
1 BACKGROUND:
1.1 On May 30, 1988, the Town of Newcastle Planning and Development Department
received an application from Diamond and Fischman on behalf of Don & Son
Building Supply Ltd. and Lunaro Construction Ltd., to rezone a 24.567 acre
parcel of land to be used for a hardware building supply outlet; a car
dealership; a fuel bar; and general industrial. The lands are located in
Part Lot 19, Concession 2, former Township of Darlington.

1.2 Staff note that Ducaoout to Council's resolution of July 26, 1982 and
the requirements of the Planning Act, the appropriate aigoage
acknowledging the application was installed on the subject lands, and
surrounding property owners were individually advised of the proposal.
2. OFFICIAL PLAN CONFORMITY
2.1 Within the Durham Regional official Plan the subject property is
within the Maple Grove Hamlet designation. Predominant development in
the Hamlets is to be residential and Maple Grove is not designated as
a "Hamlet for Gcnvvtbxv other than minor iutilliog. The proposed

development would not be considered minor nor in conformity with the
official Plan policies.
3. CIRCULATION COMMENTS
3.1 Newcastle Public Works Department
Works Staff objected to proceeding with this application until such
time as a conceptual site servicing report is prepared to the
satisfaction of the Department. The Works Department further
commented requesting a number of standard conditions be imposed on the

development, including the developer bearing I00# coat of any works on
Bloor Street and Maple Grove Road necessitated as a zeooIL of this
development.
3.2 Newcastle Fire Department
Fire Department Staff noted the site is within the zeoougized response
area of Station #I' and fire protection will be by tank truck. The
builder will further be required to comply with all sections of the
Ontario Fire and Building Codes.

3.3 Ministry of Transportation
Ministry Staff have noted concerns about Parts 1 to 3 due to the
commercial development proposed to front on Highway No. 2. They
further noted that Building and Sign Permits from the Ministry will be
required prior to development taking place.
3.4 Regional Health Department
Health Services Staff noted that more information will be required
before approval is given for development of this size on private
services.
3.5 Regional Planning Department
Regional Planning Staff note that Section 10.4.1.1 of the Durham
Regional official Plan states that residential development shall
predominate in Hamlets. Maple Grove is note designated as a "Hamlet
for Growth", according to Section 10.4.1.2 other than minor infilling.
They consider the proposed development to be major, relative to
existing development in the Maple Grove area. They have indicated the
proposal does not conform to the Regional Plan policies and have
deemed the rezoning application to be premature.
3.6 The only other agency to comment to date was the Ministry of
Agriculture and Food. Their Staff indicated no objection. Comments
remain outstanding, however, from Central Lake Ontario Conservation
Authority; Regional Public Works Department; Ministry of Natural
Resources; and Ministry of the Environment.
4. STAFF COMMENTS
4.1 Staff note a Letter of Objection has been received from a neighbouring
property owner. The concerns raised include: potential well
interference; incompatibility of uses with the existing residential
dwellings; noise; and depreciating property values.

4.2 Town Staff advised the applicant at the time the application was
received that an official Plan Amendment would be required in order
for Staff to give due consideration to the rezoning application.
Subsequent correspondence on July 20, 1988, from Staff to the
applicant, enclosed copies of agency comments advising same of
objections and concerns.
4.3 To date, an application for amendment to the Official Plan policies to
allow the proposed development has not been received. Discussions
with the applicant's agent suggested one would not be made as it would
appear to be without merit.
4.4 As noted previously, Staff are of the opinion that the application
does not conform with the Hamlet policies and is not in keeping with
existing development in Maple Grove. Regional Planning Staff have
similarily voiced the opinion. Therefore, Staff would recommend the
application be DENIED as it does not conform to the Hamlet policies
and is considered premature for the Maple Grove area.
