Subject: CEMETERY CHARGES
Recommendations:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report TR-21-97 be received;
2. THAT effective April 1, 1997, the burial cost for the Municipality of Clarington
cemeteries for burials, funded by the Department of Social Services at the Region
of Durham, be set at $1,000.00 per the proposed rates and fees as outlined in
Schedule "A" of the attached proposed By-Law;
3. THAT the charges above the prescribed amount for 1996 and 1997 as shown in
Attachment "D" totalling $695.40 be reversed;
4. THAT Council authorize one of the following options to minimize costs associated
with social service burials:
Option #1: Restrict the type of burial to an ash burial;
Option #2: Do not place any restrictions;
5. THAT the appropriate By-Law (Attachment "B") pertaining to the proposed
Schedule of Rates and Fees for Municipal cemeteries be passed and forwarded to
the Ministry of Consumer and Commercial Relations for their concurrence; and
6. THAT the area funeral homes be advised of Council's decision.

BACKGROUND AND RECOMMENDATIONS:
1.0 The standard costs were approved by Council on February 12, 1996 via Report
Addendum to WD-5-96 and By-Law #96-44 (Attachment "C") for a burial at the
Bowmanville Cemetery. An example of a typical invoice is as follows:
Regular Burial
Burial Permit $ 10.70
Cemetery Plot 765.00
Cemetery Opening 619.00
Grass & Device 66.00
Total $1,460.70
1.1 It has been brought to the Municipality's attention from both the funeral homes in the
Municipality and the Region of Durham (See Attachment "A"), that the maximum payment
that the Region of Durham will subsidize for the cost of a social services burial is
$1,000.00. This is based on provincial legislation S.34 of the Cemeteries Act. A
cemetery owner who has available space must provide a lot for a welfare burial upon
receipt of a written instruction from a welfare administrator. Such owner is entitled to be
paid the prescribed amount as provided in 5.44 of Ontario Regulations 130/92. At
present the prescribed amount is $1,000.00. This does not present any difficulties for an
ash burial because the costs per By-Law #96-44 for an ash burial is within the
$1,000.00 prescribed amount.
1.2 However, for regular burials, difficulty has arisen with the social services cases in that
the Municipality invoices the funeral homes on average, $1,460.70 at the current rates
but the Region will only subsidize $1,000.00. This may eventually lead to a refusal by
the funeral homes to handle social services cases. A regular burial including the
purchase of a grave will always exceed the $1,000.00 prescribed amount.
1.3 It is therefore recommended that for social services cases only, the Municipality's fee for
burials be set at $1,000.00 for regular burials with the following breakdown:
Regular Burial
Burial Permit $ 10.70
Cemetery Plot 765.00
Cemetery Opening 158.30
Grass & Lowering Device 66.00
Total $11000.00
1.4 The effect of this is that the Municipality will be, in essence, subsidizing social service
regular burials. However, should the funeral homes refuse to handle social services
cases, the responsibility would fall to the Municipality to deal with them directly.

1.5 The Municipality does have the option to limit its costs by dictating the type of burial (ie.
an ash burial is cheaper than a standard burial).
1.6 It is requested that Council provide direction should they wish to place restrictions on
social service burials.
CONCLUSION:
2.0 It is recommended that the fee for a regular burial at a Municipality of Clarington
cemetery for a social service burial funded by the Region of Durham, be established at
$1,000.00.

Dear Sir,
The.Department of Social Services-recently received an invoice from Morris Funeral
Home for a funeral and burial that had been authorized for payment by Social Seivices.
The costs for the burial were outlined as follows:
.Burial Permit $ 10.00
Cemetery Plot- $ 765.00 ;
Cemetery. Opening $ .619.75
Grass&Devise .. .' $ .66.00-

When Social Services authorizes a funeral home to invoice us for funeral, a letter.is sent
to the.funeral home advising them of the maximum funeral costs we are responsible for as
well as advising them that we will pay.burial costs up to a maximum of$1;000.00. Morris
Funeral Home understands that we can only pay up to our maximum;and that they are
responsible for the amounts that have been billed to them by Bowmanville' Cemetery.
I wanted the Bowmanville Cemetery to realize that most other cemeteries in Durham
Region are accepting our maximum payment o€$1,000.00.

BY-LAW 97-
Being a By-Law to amend By-Law 94-44,
being a By-Law to provide for the
maintenance, management,regulation and control
of cemeteries in the Municipality of Clarington.
THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON hereby
enacts as follows:
1. THAT By-Law 96-44 be and the same is hereby amended, by adding Section 9 as
attached to Schedule"A" attached thereto and forming part of this By-Law;
2. THAT this amended By-Law shall come into force and take effect on April 1,
1997, subject to the approval of the Ministry of Consumer and Commercial
Relations.
By-Law read a first and second time this 24th day of March 1997.
By-Law read a third time and finally passed this 24th day of March 1997.
