BACKGROUND & COMMENTS: In follow -up to earlier discussions on the bus tour and specifically as requested by Resolution CSB- 067 -88, the following information is attached: (1) a copy of 1988 Capital Budget Projects that relate to Parks, Maintenance /Development; and (2) a copy of the section of the Official Plan which defines parks. The Capital Budget papers outline money allocated, the type of project and the need for the project at each park. Relations Supervisor rtment of Community Services Attachments JL:sa N ATTACHMENT #2 b) The use of lands designated as Major Open Space shall be in accordance with the Durham Regional Official Plan; and shall be appropriate to and compatible with the areas and the adjacent land uses. (iii) Minor Open Space a) Minor Open Space areas are intended to preserve wherever possible, unique or important elements of the natural environment having local significance; and may include wood lots, hazard lands and minor water courses. b) Some Minor Open Space areas are identified on Schedule 1. Further areas may be identified in the Neighbourhood Development Plans and shall provide visual diversity and opportunities for passive recreational activities compatible with and appropriate to the area. (iv) Community Parks a) The general location of the Community Park(s) is shown on Schedule 1. More precise boundaries shall be determined in the restricted area (zoning) by -laws. b) Community Park(s) shall not be less than 8 hectares in size. c) Council shall encourage the location of future major recreational facilities within the Community Park(s). (v) Neighbourhood Parks a) The general location of Neighbourhood Parks is shown on Schedule 1. Their exact locations shall be determined in the restricted area (zoning) by and shall be detailed in subdivision and other development applications. b) Neighbourhood Parks shall not normally be less than 3 hectares in size. The size and shape of the park shall permit the development of an appropriate range of active recreational facilities to the satisfaction of Council; W W c) Neighbourhood Parks smaller than the minimum size may be permitted by Council without amendment to this Official Plan, after thorough examination of: - the size of the park relative to others within the neighbourhood; - the amount of parkland already committed for park purposes; - the physical nature of the lands in question; - the necessity for future provision of a school site. 2.3.3 Implementation (i) Public open space may be acquired by the Town by the following means: a) The land conveyance and /or acquisition provisions of the Planning Act, R.S.O. 1980 as amended from time to time; b) Purchase using monies allocated in the Municipal Budget; c) Purchase using donations, gifts, and bequests from individuals or corporations; d) Purchase using monies allocated by any authority having jurisdiction; and e) Purchase using monies included in the special account created by the municipality in accordance with Section 36(11) of the Planning Act; R.S.O. 1980. Where lands for park purposes are not required, the Town will accept cash -in -lieu of developable land. The cash -in -lieu calculation will be based on the market value of the lands the day before the day of draft approval. The market value of the lands will be determined by a qualified appraiser hired by the Town at the expense of the subdivider /developer. The calculation of the 5% cash -in -lieu will be based upon the appraised market value less development charges and costs. 4 All lands dedicated to the Town shall be conveyed in a physical condition acceptable to the Town. The Town may require that easements for access to and maintenance of watercourses be dedicated to the Town as a condition of subdivision approval. 9
