REQUEST BY KINGSBERRY PROPERTIES TO PURCHASE
PART OF BLOCK 75, PLAN 1OM -807, CASTLE HEIGHTS DRAFT PLAN OF
SUBDIVISION, WEST SIDE OF TRULL'S ROAD,
SANDRINGHAM DRIVE, PT. LOT 31, CONCESSION 2

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose & Administration
Committee recommend to Council the following: -
1. That Report No. CS -20 -89 be received;
2. That Staff be authorized to take the necessary action to sell + 609.6m2
of land being part of Block 75, Plan 1OM -807;
3. That the area of land to be sold be appraised for value based upon the
portion of each serviced lot created or enhanced;
4. That the appraisal, legal and all other costs associated with the sale be
the responsibility of the purchaser;
5. That revenue received through the sale of the property be credited to
the Parkland Reserve Fund; and
6. That Mr. Mark Foley of Kingsberry Properties be informed of action taken
by Council.
1.0 BACKGROUND:
1.1 The Town has been approached by Mr. Mark A. Foley of Kingsberry Properties
(see Schedule A & B) who wishes to purchase + 609.6m2 of table land
described as part of Block 75, Plan 10M -807, Pt. Lot 31, Concession 2 in
the Town of Newcastle. The land in question is part of an Open Space
land used for overland flow and storm storage purposes and is located on
the west side of Trull's Road off Sandringham Drive.

1.2 The various interested Departments and Agencies have been advised of the
request and invited to comment. We have received no objection to the
sale of the triangular shaped piece of land and note it can be sold without
affecting the function of Block 75 for storm purposes. The purchaser for
his part will improve the marketability of 5 lots and create 4 new lots from
currently registered blocks. It is our view that with this in mind the
land should be appraised based on the value of the nine (9) enhanced or
created lots.
