TOWN OF NEWCASTLE REPORT File # Res. # By -Law # MEETING: GENERAL PURPOSE AND ADMINISTRATION DATE: NOVEMBER 5, 1990 REPORT #: CS -41 -90 a• FILE #: BOND HEAD WATERFRONT PARR RECOMMENDATIONS: It is respectfully recommended that the General Purpose & Administration Committee recommend to Council the following:- 1. That Report No. CS -41 -90 be received; 2. That the Mayor and Clerk be authorized to enter into a lease agreement with the appropriate Federal Ministry to provide Boat Launching Facilities at the Bond Head Waterfront Park and that the appropriate By -Law be passed; and 3. That staff be authorized to make application to the Ontario Municipal Board for approval to enter into an agreement beyond the present term of Council. 1.0 BACKGROUND 1.1 Council approved the funds for the design and development of Bond Head Waterfront Park during the 1990 Capital Budget durations. Eighty -one thousand dollars were identified to begin the project's design and Phase I development. Staff subsequently advised Council on July 23, 1990 in Report CS- 31-90 of the Master Plan and proposed phasing. of park development. ../2 REPORT NO. CS -41 -90 - 2 - NOVEMBER 5, 1990 1.2 The firm of Daniel J. O'Brien Associates Ltd. as the commissioned landscape architects were directed to prepare tenders and assist the Town's Purchasing Agent in the tendering process. In addition, they were directed to proceed with obtaining all necessary approvals required from all levels of government or their agencies. 2.0 REPORT 2.1 In seeking approvals it was determined that ownership of the bank and stream bed for Graham Creek lies with the Federal Government. The Ministry of Fisheries and Oceans has recently advised the Town in a letter (Attachment 1) under what conditions approvals will be given. In brief they propose a five year lease agreement for the consideration of $100.00 per annum. To enter into a lease agreement a by -law authorizing the execution of the agreement is required. A proposed By -Law (Attachment #2) is provided for your perusal. Respectfully submitted, Jose P. L1C 3A6 Dear Mrs. Barrie: re: Draft Management Lease Launching Ramp partial encroachment and Small Craft Harbour facilities Newcastle, Ontario, Reference is made to Mr. Daniel O'Brien's letter of September 17, 1990 (a copy of which was sent to Mr. Jim Cameron) regarding the above matter. Enclosed is a draft Management Lease, in triplicate, for a five -year period commencing October 1, 1990, and it would be appreciated if you would have the Lease executed and sealed on behalf of the Town and return all three copies to this office, together with a cheque in the amount of $100.00, made payable to the Receiver General for Canada, which is that part of the rent required at this time in accordance with paragraph (a) of the Lease Reddendum Clause. When returning the documents, please also include a duly certified copy of a By -law authorizing the execution of the Lease on behalf of the Town. O'Brien Canada ATTACHMENT #2 THE CORPORATION OF THE TOWN OF NEWCASTLE BY -LAW 90- being a By -law to authorize the entering into a Lease Agreement with Her Majesty the Queen represented by the Minister of Fisheries and Oceans and the Corporation of the Town of Newcastle for launching ramp partial encroachment and small craft harbour facilities.. The Council of the Corporation of the Town of Newcastle hereby enacts as follows: 1. THAT the Mayor and Clerk are hereby authorized to execute on behalf of the Corporation of the Town of Newcastle, and seal with the Corporation's seal, the lease between Her Majesty the Queen represented by the Minister of Fisheries and Oceans and the said Corporation; and 2. THAT this by -law come into effect upon approval of the Ontario Municipal Board.
