THAT report PSD-027-05 be received; 2. THAT Council pass a By-law to extend the period of time that Interim Control By-law 2004-061 would be in effect as contained in Attachment 1 to this report; and 3. THAT notice of passing of the extension of Interim Control By-law 2004-061 be given in accordance with Subsection 38(3) of the Planning Act, R.S.O. 1990, C.P. 13 as amended. The report recommended that the consultant not be hired until funding had been secured. In report PSD-089-04, presented to Council on June 28, 2004, it was recommended that the consultant team lead by Urban Strategies be retained to undertake the South Courtice Business Park Study. 1.2 Due to expressed interest in development of the lands, and to provide the Municipality with a "breathing space" to examine land uses, Council, on March 1, 2004, passed an Interim Control By-law (2004-061) for these lands. 2.0 STAFF COMMENTS AND RECOMMENDATIONS 2.1 Since Council first authorized the Study of the South Courtice Business Park, it has taken some time to determine the economic development strategy which would provide the foundation for the land use planning component of the Study. In the Spring of 2004, the municipality was participating on a study of the Greater Toronto Marketing Alliance of the Energy and Environment Industries (EN2)in the Greater Toronto Area. One of the emerging recommendations was for the concept of an EN2 Park, a physical location for the cluster of companies and institutions focused on the Energy and Environment sectors. Strong links to academic institutions, in particular with University of Ontario Institute of Technology (UOIT), was indicated. 2.2 Using this as a basis, staff worked jointly with the Region and the UOIT to develop a proposal for funding to the Federal Government to assist with the broad range of effort required for this Study, including both land use, urban design, infrastructure and marketing. The Study is a joint effort of the Municipality, the Clarington Board of Trade, the Region of Durham and the UOIT. The Federal Government is contributing 50% of the costs of the Study. REPORT NO.: PSD-027.05 PAGE 3 There has been excellent progress made to date on the Study with three (3) steering committee meetings, stakeholder interviews and a visioning session with potential stakeholders being conducted to date. The options analysis component of the study will be concluded shortly, the outcome of which will be the identification of a development master plan and a servicinglinfrastructure plan. A public information session will be held in March 2005. The final report will include a marketing plan, a financial plan for the cost sharing of services and amendments to the Official Plan, including a secondary plan, amendments to the zoning by-law and design guidelines. After the completion of the consultants report, staff will evaluate the recommendations and prepare the proposed amendments to the Clarington Official Plan and Zoning By-law. It is anticipated that proposed changes to the planning instruments will be presented for Council's consideration fall 2005. 2.4 The Interim Control By-law (2004-061) for these lands expires on March 1,2005. It is recommended that Council extend the Interim Control By-law for another year. This will enable the study to be completed and the related amendments to the Official Plan, including a secondary plan, and the amendments to the zoning by-law be passed. Once the appropriate amendments to the Official Plan and Zoning By-law have been approved and are in force Council may consider repealing the Interim Control By-law. Solina Road. CN Railway and Courtice Road: WHEREAS at its meeting on March 1.2004, Council directed Staff to undertake the review or study of land use planning policies for the South Courtice Employment Lands and adopted Interim Control By-law 2004-061; WHEREAS Staff prepared Report PSD-027-05 providing an update on the status of the South Courtice Business Park Study and advised that a one-year extension to the Interim Control By-law for the subject lands is appropriate: WHEREAS By-law 2004-061 expires on March 1,2005 and Council deems it expedient to pass a By-law under Section 38 of the Planning Act. R.S.O. 1990, c.P.13, as amended: NOW THEREFORE. the Council of the Corporation of the Municipality of Clarington hereby enacts as follows: 1. Section 3 of By-law 2004-061 is amended by deleting the word "one (1)" and replacing it with the word "two (2)". 2. This By-law shall come into effect on the date of the passing hereof.
