2. Background

2.1 On September 22, 2022, a building permit application was received for a proposed
second storey deck to the existing single -detached dwelling. There is currently a second
storey deck, but it will be replaced and enlarged. Upon receipt, Planning Staff informed
the applicant that a minor variance was required for the proposed deck.
2.2 On September 23, 2022, Planning Staff received an application for Minor Variance from
the homeowners for 139 Yacht Drive, Bowmanville. The application seeks to facilitate
the construction of a second storey deck by reducing the interior side yard setback from
0.6 metres to 0.46 metres and to increase lot coverage from 45% to 49.5%.
3. Public Notice and Submissions
3.1 Due to an administrative error, the notice for this minor variance application is incorrect.
A map to a different property was included in the public notice that was mailed out for
this application. The requirements of the Planning Act for public notice mailout, require
the property location description and map.
4. Conclusion
4.1 Given the above comments, Staff recommends the subject application be tabled to the
next Committee of Adjustment Meeting to allow for appropriate public notice, per the
requirements of the Planning Act.
