REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE
MEETING OF MARCH 19, 1984.
SUBJECT: RELEASE OF A SUBDIVISION AGREEMENT
WALTER SCHHC,EEISS CONSTRUCTION
REGISTERED PLAN 638, IN THE
FORMER TOWN OF BOWMANVILLE
RECOMMENDATION:
It is respectfully recommended:
1. That this report be received; and,
2. That the Town solicitor prepare the necessary
documentation for the execution and final release of
the Subdivision Agreement between Walter Schleiss
Construction and the Town of Bowmanville; and,
3. That the Mayor and Clerk be authorized to issue the
Certificate of Release on behalf of the Town.
In June 1963, the Corporation of the Town of Bowmanville
entered into a Subdivision Agreement with Walter Schleiss
Construction, for the construction of a residential
subdivision as described in Registered Plan 638.

In February, 1984, the Town received correspondence from
solicitors Strike & Strike, advising the Town that this
development agreement was never released. A title search
for a property owned by their client revealed that the
Subdivision Agreement was never formally released and,
thereby, would not give the new owner clear title to his
property. The Town has consequently been requested by
Strike & Strike to formally release the Subdivision
Agreement, thereby, clearing title for their client.
Since the Town has assumed aryl maintained this subdivision
for severl years, and there are no outstanding works nor
claims relating to the works, it is hereby recommended that
the final release be executed in accordance with the terms
and conditions of the Subdivision Agreement.
