SUBJECT: DEDICATION OF ROAD WIDENINGS ON
KING STREET EAST, BOWMANVILLE
ADJACENT TO STRATHAVEN NURSING HOME
RECOMMENDATION:
It is respectfully recommended:
1. That this report be received; and,
2. That a by -law be passed by Council for the dedication
of Part 6, Plan 1OR -1732, and Part 2, Plan R.D. 64, as
public road allowance.
3. That the law firm of McMaster & Meighen be advised of
Council's actions in this matter.

Through the approval process and site plan agreement for the
expansion to the Strathaven Nursing Home, title to a road
widening of approximately 0.86 metres (2.8 feet) was
transferred to the Town. Over the years, even as far back
in time as when King Street was a highway, similar widenings
were acquired from adjacent lands to provide for a full
sixty -six (66') foot right -of -way centred about the road
centreline.
The road allowance widening has been deeded and registered
and the developer's lawyers have requested its dedication as
public road allowance. Similarly, in 1973, a road widening
was transferred to the Ministry of Transportation and
Communications, but was not dedicated. It is, therefore,
recommended that both portions of widening be now dedicated,
by by -law, as public road allowance.

Further to our telephone conversation of April 18,
1984, we enclose the information requested and ask that you
recommend to Council that a Dedicating By -Law be passed.
The land shown on Reference Plan 1OR -1732 as Part 211
Plan R.D. 64 was conveyed by John Allison Higginson and Joan
Louise Higginson to Her Majesty The Queen in right of the
Province of Ontario, by a Deed dated April 11, 1973 and
registered on June 1, 1973 as Instrument No. 59824.
The land shown as Part 6 on Reference Plan 1OR -1732 was
conveyed by Beaucage Holdings Limited to The Corporation of the
Town of Newcastle by a Deed registered as Instrument No. 61694.
This conveyance was made in accordance with a Development
Agreement dated September 29, 1983 and registered November 71
1983 as Instrument No. 114702.
