(416) 263.2231 LOB 1JO 987.5039 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF MAY 22, 1984. REPORT NO.: WD -53 -84 SUBJECT: PERMISSION FOR ENCROACHMENT OF A PRIVATE DWELLING ON TOWN -OWNED ROAD ALLOWANCE, SCUGOG STREET - BURKETON. RECOMMENDATION: It is respectfully recommended: 1. That this.report be received; and, - 2. That permission be granted to Douglas James and Katherine Ann Chumbley, their heirs, successors & assigns, the right to maintain and use such portion of the building as constitutes an encroachment upon a public highway, for so long as the encroachment is not required for municpal purposes or until such time as the building is removed, said encroachment being over Part 3, Plan 1OR182O. 3. That the attached by -law to permit the continuation 'of an encroachment to Town -owned lands by Douglas James and Katherine Ann Chumbley, Scugog Street, Burketon, over Part 3, Plan 1820, be enacted. ...2 V = 60 Page 2 REPORT NO. WD -53 -84 REPORT: Through the transaction for the sale of a property on the west side of Scugog Street, north of Pine Street, in Burketon, it was found that the building was'encroaching onto the Scugog Street right -of -way. In order to permit the sale to proceed, official recognition of the encroachment is required. �. The location has been reviewed and it was found that the encroachment has not, nor will it hamper the use of the road by either vehicles or pedestrians. Thus, it may continue until the Town requires the full width-of the street for municipal works or until such time as the building is demolished or removed. It is, therefore, recommended that the attached by -law authorizing the encroachment over Part 3, Plan 1OR1820, be enacted. Respectfully submitted, R. G. Dupuis, P. Eng., Director of Public Works.
