ZONING BY-LAW AMENDMENT TO PERMIT THE CONSTRUCTION OF TWO
RESIDENTIAL DWELLINGS
APPLICANT: BAYWOOD HOMES
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PSD-022-05 be received;
2. THAT provided there are no significant issues raised at the public meeting, the rezoning
application submitted by Baywood Homes be APPROVED and that the attached Zoning
By-law Amendment be adopted by Council; and,
3. THAT all interested parties listed in this report and any delegations be advised of
Council's decision.

1.0 APPLICATION DETAILS
1.1 Owner:
Vermont Village Homes Inc.
1.2 Applicant/Agent:
Baywood Homes
1.3 Rezoning:
from "Urban Residential Type One (R1) Zone" to "Urban
Residential Exception (R2-26) Zone" to permit the
construction of two detached dwellings.
1 .4 Location:
The area subject to the proposal is located on two partial lots
known municipally as 77 and 85 Stephens Gulch Drive,
being Part of Lot 9, Concession 2, former Town of
Bowmanville.
1.5 Area:
approximately 260 square metres
2.0 BACKGROUND
2.1 On January 13, 2005, the Planning Services Department received an application to
rezone Blocks 101 and 102 in registered Plan of Subdivision 40M-2172, to be
consistent with the zoning on Blocks 137 and 138 in registered Plan of Subdivision
40M-2096 to permit the construction of two (2) single detached dwellings. The current
zoning is different in each registered Plan.
3.0 LAND CHARACTERISTICS AND SURROUNDING USES
3.1 77 and 85 Stephens Gulch Drive are currently addresses of blocks that need to be
rezoned to permit building permit issuance and dwelling construction. These lands are
vacant and slope gently to the east. The site is surrounded by urban residential uses.
4.0 PUBLIC NOTICE AND SUBMISSIONS
4.1 Public notice was given by mail to each landowner within 120 metres of the subject
property and a public notice sign was installed on the Stephens Gulch Drive frontage.
4.2 As a result of the public notification process, to date, the Planning Services Department
has received no inquiries.
5.0 OFFICIAL PLAN CONFORMITY
5.1 The Clarington Official Plan designates these lands as "Urban Residential, Low Density"
area. The application conforms.

6.0 ZONING BY-LAW COMPLIANCE
6.1 Within Comprehensive Zoning By-law 84-63 of the former Town of Newcastle, these
lands, two blocks, are "Urban Residential Type One (R1) Zone". The two blocks
abutting on the north, are "Urban Residential Exception (R2-26) Zone". The proposed
rezoning gives the subject blocks the same zoning as the complementary blocks to the
north, that is, "Urban Residential Exception (R2-26) Zone".
7.0 AGENCY COMMENTS
7.1 The rezoning application was circulated to only the Engineering Services Department
and it had no objection to the rezoning.
8.0 STAFF COMMENTS
8.1 The proposal is a minor technical amendment to the zoning boundary that facilitates the
combining of blocks to create whole lots that permit the construction of detached
dwellings in compliance with all relevant zoning regulations such as frontage and
setbacks. Staff have not received any inquiries and do not anticipate any objections
being raised at the public meeting.
8.2 The Finance Department advises that the taxes have been paid in full.
9.0 RECOMMENDATION
9.1 Based on the comments in this report, it is respectfully recommended that the rezoning
application be APPROVED.

CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY -LAW NUMBER 2005-_
being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for
the Corporation of the former Town of Newcastle
WHEREAS the Council of the Corporation of the Municipality of Clarington deems it
advisable to amend By-law 84-63, as amended. of the Corporation of the Municipality of
Clarington to implement application ZBA 2005-001:
NOW THEREFORE BE IT RESOLVED THAT. the Council of the Corporation of the
Municipality of Clarington enacts as follows:
1. Schedule "3" to By-law 84-63, as amended, is hereby further amended by
changing the zone designation from "Urban Residential Type One (R1) Zone~ to
"Urban Residential Exception (R2-26) Zone~ as illustrated on the attached
Schedule "A" hereto.
2. Schedule "A" attached hereto shall form part of this By.law.
3. This By-law shall come into effect on the date of the passing hereof, subject to
the provisions of Section 34 of the Planning Act.
