Recommendations:
It is respectfully recommended:
1 . THAT Report CD-41-96 be received;
2 . THAT the by-laws attached to Report CD-41-96 be passed by
Council; and
3 . THAT the Clerk be authorized to carry out all actions
necessary to complete the process of property designation
pursuant to the Ontario Heritage Act, R.S .O. 1990, c .0 . 18
and detailed within Report CD-41-96 .
BACKGROUND AND COMMENT:
On May 27, 1996, Council adopted the recommendations of the
General Purpose and Administration Committee which
dealt with the designation of the subject properties . As
detailed in Report PD •79-96, the Clerk was authorized to proceed
with designating the subject properties as historic properties .
The Notice of Intention to Designate was forwarded to the owners
of the properties and to the Ontario Heritage Foundation and was
also published in the local newspaper. With the passage of
Bill 20 , the requirement to publish the Notice of Intention has
been amended such that the publication needs to occur once rather
than three times as was previously required.
The period for filing objections to the proposed designation ends
on July 8 , 1996 . As of the time of preparation of this report,
no objections have been filed. As no objections have been filed,
it is appropriate that the designation continue. This process
involves :

• certified copy of the by-laws forwarded to the Ontario Heritage
Foundation
• by-laws registered on title
• Local Architectural Conservation Advisory Committee advised of
designations
The Local Architectural Conservation Advisory Committee is
anxious to have the by-laws passed at tonight' s meeting as the
homeowners of 192 Lovekin Road will be presented with the plaque
for their home during the Clarke bicentennial celebrations on
July 13 , 1996 .

96- 131 was corrected between
1996 and 2011 to change the
address from 192 Lovekin to 196
Lovekin . Both addresses form
part of the same parcel , but had to
be registered under 196 Lovekin in
2011 .
This correction has also been
noted on related By- law 96- 131 .

being a by-law to designate the property known

Part Lot 35, Concession 1, former Township of Clarke
as a property of historic or architectural value or
interest under the Ontario Heritage Act.
WHEREAS the Ontario Heritage Act, R.S.O. 1990, c.0 .18
authorizes the council of a municipality to enact
by-laws to designate properties to be of historic or
architectural value or interest for the purposes of the
Act;
WHEREAS the Council of The Corporation of the
Municipality of Clarington has caused to be served upon
the owner of the property known for municipal purposes
as 192 Lovekin Road, Part Lot 35, Concession 1, former
Township of Clarke, and upon the Ontario Heritage
Foundation, Notice of Intention to Designate the
aforesaid real property and has caused such notice of
intention to be published in the Newcastle Independent
and the Canadian Statesman, newspapers having general
circulation in the area of the designation, on June 8
and 12, 1996;
WHEREAS the reasons for the designation of the
aforesaid property under the Ontario Heritage Act are
contained in Schedule 11311 hereto;
WHEREAS the Local Architectural Conservation Advisory
Committee of the Municipality of Clarington has
recommended that the property known for municipal
purposes as 192 Lovekin Road, Part Lot 35,
Concession 1, former Township of Clarke be designated
as a property of historic or architectural value or
interest pursuant to the Ontario Heritage Act;
WHEREAS no notice of objection to the proposed
designation was served upon the Clerk within the period
prescribed therefore by the Ontario Heritage Act.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE
MUNICIPALITY OF CLARINGTON HEREBY ENACTS AS FOLLOWS:
1. The property known for municipal purposes as
192 Lovekin Road, Part Lot 35, Concession 1,
former Township of Clarke more particularly
described in Schedule "A" which is attached to and
forms part of this by-law, is hereby designated as
a property which has historic or architectural
value or interest under Section 29 of the Ontario
Heritage Act 'R.S.O. 1990, c.0.18.
2. The reasons for designation of the property
described in Schedule "A" hereto are set out in
Schedule "B" which is attached to and forms part
of this by-law.
3 . The Solicitor for the Municipality of Clarington
is hereby authorized to cause a copy of this
by-law to be registered against the title to the
property described in Schedule "A" hereto.

4. The Town Clerk is hereby authorized to cause a
copy of this by-law to be served upon the owner of
the property described in Schedule "A" hereto and
on the Ontario Heritage Foundation. The Clerk is
also authorized to cause notice of the passing of
this by-law to be published in the Newcastle
Independent and the Canadian Statesman, newspapers
having general circulation in the area of the
designation.

of this by-law.
3. The Solicitor for the Municipality of Clarington
