REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE
MEETING OF JULY 3, 1984.
REPORT NO.: WD -67 -84
SUBJECT: CLOSURE AND CONVEYANCE OF A PORTION OF
DURHAM STREET AND DARLINGTON STREET
(UNOPENED) LYING BETWEEN AND ADJACENT TO
LOTS 155 & 156 ON WILSON, ARMOUR AND
MEARNS PLAN IN THE FORMER TOWN OF BOWMANVILLE.
RECOMMENDATION:
It is respectfully recommended:
1. That this report be received; and,
2. That the unopened portion of Durham Street and
Darlington Street lying between and adjacent to Lots
155 & 156 on Wilson, Armour and Mearns Plan in the
former Town of Bowmanville, more particularly
described as Part 3, Plan 1824, be closed by by -law
and conveyed to the abutting owners; and,

REPORT:
The attached petition has been received from the owners of
the home situate on the subject lands for closure and
conveyance of the road allowance depicted on the plans
attached. Discussions with both the applicant's and Town's
solicitor would suggest that closure and conveyance is the
proper procedure to follow. The applicant's solicitor has
been provided with the Town's policy and procedure in such
matters and has made a submission in accordance with the
policy. As the lands are presently occupied by the
applicant, are of no foreseeable use to the Town, and are
only of value to the applicant, the proposed closure and
conveyance are appropriate.
Part of the submission included an appraisal of the value of
the land which considered its present and zoned use, and
comparable sales of similar properties. This appraisal
which is available in the Works Department, is considered
valid and recommends that the value of Part 3, Plan 1OR1824
be established at $3,700.
It is, therefore, recommended that the closure and
conveyance proceed on this basis and in accordance with Town
policy.

P E T I T I O N
For closure and conveyance of Durham Street situated:
All of Durham Street, lying between Lots 155 and 156 on
Thomas Wallis Herrick's Plan of Subdivision, being in the Town of Newcastle,
in the Regional Municipality of Durham.
I, the undersigned, being the owner of property through
which the above Street runs, do hereby petition the Council. of the Town of
Newcastle to close same by by -law, and convey the lands thus gained, in
accordance with the terms and conditions,;of the Municipal Act, R.S.O. 1980.
Attached to this Petition is an R -Plan.
I hereby agree that, upon Council approval of my petition,
I will register the R -Plan, and will accept the responsibility for any costs
involved in finalizing any and all transactions, as apportioned in accordance
with the size of the parcel of land gained.
I further agree to pay to the Town of Newcastle the sum of
Two hundred and Fifty Dollars for the administration of this petition.
