MEETING OF JULY 15, 1984.

SUBJECT: REPORT ON CORRESPONDENCE FROM MARWOOD
i PROPERTIES LIMITED REQUESTING THE TOWN
TO PAVE MEARNS AVENUE SOUTH OF THE BASE
LINE ROAD -IN BOWMANVILLE -------------------
RECOMMENDATION:
It is respectfully recommended:
1. That this report be received; and,
2. That paving of Mearns Avenue, south of Baseline Road
in Bowmanville be included in the Town's Hot Mix
Paving contract, with associated costs of about
$30,000. to be drawn from the Industrial Development
Account # 5001- 899 -4 -3 subject to the following:
a) The conveyance to the Town by Marwood Properties
Limited of Part 12A Plan IOR -750.

b) Development of at least 40% of the abutting lands
or construction of one or more substantial industries
requiring a paved road for access.
c) Agreement from Marwood Properties Limited for the
conveyance of an easement to the Region of Durham
for construction of a watermain loop between
Mearns Ave. and Caristrap Ave.
3. That a copy of this report be forwarded to Marwood J
Properties Limited.

REPORT:
The attached correspondence from Marwood Properties Limited
in the 6th, paragraph, suggests that the Town has an
obligation to pave Mearns Avenue south of Baseline Road in
Bowmanville. A review of the files confirms that a
committment was made by the Town for such paving. In July
1976 the Town's Industrial Committee recommended to Council
in part:
"that the Municipality should build the road
on Mearns Avenue road allowance south of Base
Line, but not until next year, and that it
not be asphalted till a later date and subject
to Regional Services being installed first."
In this regard the files indicate that Mearns Avenue was
constructed, including Regional sanitary and water services.
Paving was, however, not included, but at such time as there
is sufficient development, an asphalt surface would be
appropriate. It appears that the original construction was
paid for by the Town, since M.T.C. , in their design criteria
approval, noted that the project would not be subsidized.
With respect to the conditions being suggested, the following
logic is offered:
a) Conveyance of Part 12A, Plan IOR -750 is requested.
The cul -de -sac built at the south end of Mearns Ave.
is located on Part 12 A, therefore the land should
become part of the road allowance.
b) It is suggested that paving not proceed until at least
40% of the land has been developed or the need is
generated by construction of substantial industrial
buildings. Since there has been much discussion
recently about the need for improvements on Baseline
Road, it would not be prudent on the part of the Town

to pave the road where no industry exists and leave
Baseline in its present state. This paving should
be scheduled only when significant industrial devel-
opment warrants same. Costs for the paving would be
about $20,000. with about $10,000. required for
shoulder, boulevard and ditch cleanup.
c) An easement for watermain looping is required. In
correspondence dated June 1977, Marwood Properties
did agree to provide such an easement, if required
by the Region. This matter should be pursued and the
recommendation in this report will serve to spur
further discussion.
If paving of Mearns Avenue can generate the development
suggested in the letter from Marwood Properties it would
be a wise investment. However, Council may wish some assurance,
as recommended in this report, that such development will
occur.
