REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE
MEETING OF SEPTEMBER 17, 1984.
REPORT NO.: WD -78 -84
SUBJECT: INSTALLATION OF FENCE AND GATES TO
CONTROL VEHICULAR ACCESS TO THE
UNOPENED /UNIMPROVED OSHAWA /NEWCASTLE
TOWNLINE ROAD ALLOWANCE IN THE 6TH
CONCESSION OF THE FORMER TOWNSHIP
OF DARLINGTON.
RECOMMENDATION:
It is respectfully recommended:
1. That this report be received; and,
2. That in order to control vehicular access and thus
minimize damage and nuisance to property owners,
adjacent to the Oshawa /Newcastle Townline Road
allowance in the 6th Concession of the former Township
of Darlington, a fence and locked gate be installed at
both the north and south ends of the subject road
allowance.
3. That recommendation 2 above, be subject to the
condition that all abutting property owners and the
City of Oshawa provide written concurrence with the
proposal.

4. That if the proposal proceeds, all of the abutting
property owners be provided with complimentary keys to
allow them access to their lands.
5. That a copy of this report be forwarded to the City of
Oshawa with the request that they indicate concurrence
and agree to pay fifty percent (50 %) of the cost of
the fence and gate installation to be performed by the
Town.
REPORT:
The road allowance in question has been the subject of much
discussion at Council due to ongoing complaints received
from Mr. Mark Hancock about its condition. More recently,
the attached letter was received from Mr. Brian Lee voicing
similar complaints, but proposing a solution which has been
tried and found to be quite successful on two unimproved
roads in the City of Oshawa. The matter was discussed with
City staff who provided background material on actions taken
by Oshawa in that regard. The approach proposed in this
report is fairly consistent with that employed by Oshawa.
The Town's Policy for unimproved roads makes provision for
this type of situation but does stipulate "closure by
by -law" and subsequently, fencing. In this case however,
the road in question is a boundary road and closure by
by -law would be quite unwieldy. Furthermore, there have
been discussions of the Townline Road possibly becoming a
major north -south route, and actions should not be taken
which would bar such an eventuality.

A proposal similar to that being suggested was considered
for the Union School Road in the 9th Concession of
Darlington about two years ago, however, the Town Solicitor
advised that the Municipality could not be selective in whom
it allowed to use road allowances, and the matter did not
proceed. Notwithstanding this advice, the approach has been
successful in Oshawa and is achieving the desired results.
It is, therefore, recommended that it be applied on the
Townline Road, with the knowledge that if problems with
logistics or legal matters occur, alternative action such as
closure by by -law or removal of the fence and gate
installation can occur. In any case, the proposal should
proceed only upon written concurrence of all involved
parties.
