(416) 263 -2231 987 -5039 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF OCTOBER 15, 1984. REPORT NO.: WD -80 -84 SUBJECT: BRIDGE OVER HIGHWAY 35/115 BETWEEN HIGHWAY 2 & HIGHWAY 401 (LOVEKIN). RECOMMENDATION: It is respectfully recommended: 1. That this report be received for information. REPORT: Subsequent to Council's adoption of the recommendations of Report WD- 75 -84, correspondence was directed to M.T.C. to determine the following: 1. What is the history to the subject crossing? 2. Why was the Town not involved in discussions? 3. What is M.T.C.'s expectation with respect to the Town's maintenance obligation on the subject crossing? 4. What arrangements are being made for maintenance at other Town road and Highway 35/115 intersections? ....2 r Page 2 REPORT NO. WD -80 -84 The attached response from M.T.C. answers in part, questions 1 and 2 and deals with question 4. The respondent has erroneously assumed that previous correspondence between Town and M.T.C. staff has dealt with the question of maintenance of the subject crossing. In fact, our files show no correspondence on this particular matter. Referring to the January 26, 1983, and February 14, 1983 letters would indicate that discussions contained in same related to the section of Highway 35/115 from the C.P.R. northerly. The C.P.R. is north of Highway 2, therefore, the subject crossing would not have been covered by that correspondence. Thus, while our question about maintenance of the Lovekin bridge and associated ramps has not been answered, it is fairly safe to assume that M.T.C. will deal with it through a maintenance agreement similar to those at other locations. The whole matter could be pursued further with M.T.C., however, I think we have sufficient information to answer our questions. RGD:jco P .. � • � g ,gay Ontario ®w,�lE�,C,_. Director of Public Works Corporation of the Town of Newcastle Hampton, Ontario LOB 1JO Dear Sir: Re: Highway 35/115 - Modified Interchange Between Highway 401 and Highway 2 ( Lovekin Reference is made to your letter of September 27, 1984 to Mr. E. J. McCabe concerning the status and future maintenance of the structure and approach roads at the above location. I might add that I was questioned on this matter by Mayor Garnet Pickard of Newcastle at a recent meeting at our Minister's Office and promised to review the situation. I can advise that the construction of this interchange by the Ministry resulted from negotiations and property settlements with the Lovekin family and an outstanding legal judgment pertaining to access to which the Ministry was legally obligated. Prior to construction the Town of Newcastle was approached by our Project Manager under letter dated January 26, 1983 (copy attached) which covered plans for our project on Highway 35/115 and advised that following construction, a maintenance agreement covering jurisdiction limits and maintenance cost sharing will be prepared between the Town and our District Office in Port Hope. In your reply dated February 14, 1983 you had no comments on our design and gave general concurrence to our proposals for construction at Town Roads. I might add that a similar arrangement has been concluded with the Regional Municipality of Durham where their roads intersect Highway 35/115. 2 _ Mr. R. G. Dupuis, P. Eng. October 3, 1984 Accordingly the Ministry has assumed the authority for new roadways at new interchanges for construction purposes and will pay the full cost of structure and roadway work as well as adjustments to existing municipal road intersections. As previously advised the new jurisdictional limits and appropriate cost sharing arrangements will be negotiated by our District Office. I trust that this arrangement will be satisfactory. M2N 6E9 January 26, 1983 Re: Hwy. 35/115 Improvements, between CPR and Regional Rd. 4 Regional Municipality of Durham, Town of Newcastle W.P. 7 -79 -01 & W.P. 7 -79 -13 Enclosed for your information are one set of construction grading plans, profiles, typical cross— section and illumination layout. The design is complete. The work project 7-79 -01 will be awarded in August of this year, while work project 7 -79 -13 will be awarded, most likely, the-following year. Since some of the construction will take place on the roads under your jurisdiction, we would appreciate receivinq a letter from your office giving us permission to do so. After construction, a maintenance agreement will be prepared between your offices and our District 7. A letter to this effect was also mailed to the Regional Municipality of Durham. Please advise.
