HomeMy WebLinkAboutWD-59-87 TOWN OF NEWCASTLE REPORT Res. # By-Law # MEETING: GENERAL PURPOSE AND ADMINISTRATION MEETING DATE: DECEMBER 7, 1987 REPORT #: WD-59-87 FILE #: SMECT: ROAD ALLOWANCE DEDICATION EXPROPRIATION OF PART OF LOT 32, CONCESSION 7 SHOWN AS PART 7, DEPOSITED PLAN N28303 OF PLAN 1OR1283 (LESKARD ROAD) FORMER TOWNSHIP OF CLARKE RECOMMENDATIONS: It is respectfully recommended: 1. That this report be received; and, 2. That Part 7 on deposited plan N28303 of Plan 1OR1283, in Lot 32, Concession 7, of the former Township of Clarke be dedicated as a public road allowance; and, 3. That a dedicating by-law be passed; and, 4. That the Mayor and Clerk be authorized to execute the necessary documents. 5. That a copy of the by-law be forwarded to McGibbon, Bastedo Armstrong and Armstrong, Barristers and Solicitors, P.O. Box 2396, 32 Simcoe Street South, Oshawa, Ontario, L1H 7V6. . . .2 Page 2 Report WD-59--87 In December, 1965, the former Township of Clarke obtained land for road widening purposes through expropriation, however, there is no evidence that a dedicating by-law was passed. Lawyers acting on behalf of clients purchasing land abutting this road allowance have requested that the appropriate by-law be passed dedicating Part 7 on registered Plan of Expropriation N28303, and shown on Plan 1OR1283 attached, as road allowance. (The plan is several feet long) 3 . Copy of survey of the above-noted property (Plan 1OR1283) indicating the location of said Part 7 in relation to the property. Would you kindly arrange for the relevant by-law to dedicate Part 7 on said Plan N28303 as a public roadway.
