RECOMMENDATIONS:
It is respectfully recommended:
1. That Report WD-44-87 be received; and,
2. That the Ministry of Transportation & Communications be advised that
the Town of Newcastle supports Mr. John W. McCormick of 158 Stacey
Avenue, Oshawa, Ontario, in his efforts to secure approval from M.T.C.
for an access to his lands at the northwest corner of Concession Road
3, Clarke, and Highway 35/115 for the purposes of building a single
family dwelling; and,
3. That a copy of this report be forwarded to Sam Cureatz.

REPORT:
During the 1987 Public Works Road Tour, the interchange on Highway 35/115
and Concession Road 3 was visited and it was explained that M.T.C. had
advised Town staff that they would like the Town to assume ownership and,
subsequently, responsibility for future reconstruction and maintenance for
what, in staff's opinion, are ramps (with underpasses etc. ) to and from
Highway 35/115. It was indicated that staff had not accepted M.T.C. 's offer
to assume these sections of highway into the Town' s road system.

Mr. McCormick has recently purchased what could be described as a section of
the inside of the cloverleaf at Highway 35/115 and Concession Road 3, Clarke
(see attached correspondence). There is presently an approved agricultural
entrance with a culvert and gravel driveway, however, in order to be in a
position to receive a building permit for a single family home at this
location, Mr. McCormick needs M.T.C. approval to upgrade the entrance from
its present agricultural status. The access in question is onto the M.T.C.
owned portion of roadway leading down to the underpass. M.T.C. explains
that common practice is to restrict access onto portions of the interchange.
M.T.C. also explained to Mr. McCormick that if the Town were to assume
ownership of the road in question (i .e. the ramp to the underpass) , then the
Town could allow access if they saw fit.

It is still staff's position that the Town should not assume ownership of
the ramp and the associated liabilities and that the question of access to
Mr. McCormick's property is one between Mr. McCormick and M.T.C. , however,
in response to Mr. McCormick 's request for support in his efforts, I submit
this report for Council 's information and action.

Dear Sir
I would greatly appreciate your support in helping me, John W. McCormick of
158 Stacey Avenue, Oshawa, Ontario. To persuade the Ministry of Trans. &
Comm. & the Town of Newcastle to approve the access to may property situated
at N.W. corner of Clarke 3rd Line & #35/115 Highway. Presently, there is
already an access to the property but the M.T.C. is calling it an access for
farm vehicles only. I bought this lot which is 1.79 acres in good faith
thinking I would be allowed to build a single family residence.
Allowing me a residential access, which would only be used an average of 2-4
times a day & has a clear view entering & exiting at present access would be
less hazardous to traffic than slow moving farm vehicles.
The cost of this lot was $53,000.00 & all extras since then. My house in
Oshawa is up for sale & if I can't get the O.K. for the access it would all
be for nothing.
Enclosed is a drawing of the lot & proposed site of residence. Although
some say you can 't win against the government, I feel confident a favourable
decision will be made.
