REPORT #i4D-43-87 FILE #: SUB,ECT: SIDEWALK CONSTRUCTION RECOMMENDATIONS: It is respectfully recommended: 1. That Report WD-43-87 be received; and, 2. That the new sidewalk construction projects approved in the 1987 Budget proceed without local improvement financing; and, 3. That Public Works lot levies be used in lieu of the local improvement portion of the financing of new sidewalk construction; and, 4. That the Town of Newcastle Sidewalk Policy be revised as per the attached revised policy. . . .2 Page 2 Report No. WD-43-87 REPORT: In the 1987 Budget, new sidewalk construction was authorized on Highway # 2 in the Courtice Urban Area and on Sunset Boulevard in Newcastle Village. Part of the proposed financing of these two projects called for local improvement in the amount of $30,000.00 and $3,000.00, respectively. During the 1987 Budget review, some concerns were raised about the inclusion of local improvement as part of the financing package for the sidewalk works, however, no changes were formally requested or made in the budget. After further consideration of the existing sidewalk policy and some possible revisions to the policy, the following is recommended: that the sidewalk policy be revised to allow for construction of new sidewalks without local improvement financing when carried out as a result of development activities or as part of a school route. Having investigated the procedures required to use local improvements to help fund the sidewalks in the 1987 Budget, it has become apparent that if local improvement financing is to be pursued, the timing of construction would be late in October at the earliest and if objections were to take the issue to the O.M.B. , which is not unlikely since the sidewalk construction works were initiated by the Town and not by petition of the abutting and benefitting property owners, the projects could be delayed until next year. .. . .3 . � Page 3 Report No. WD-43-87 The existing policy allows for new sidewalk construction undertaken in conjunction with major road construction or updating. In order to get on with the sidewalk works on Highway 2 in the Courtice Urban Area in July or August of 1987, it is recommended that these works be considered as part of the Highway # 2 widening and reconstruction project of 1986 and therefore the requirement for local improvement financing would not apply. Because the sidewalk construction is somewhat related to new development, it is recommended that the funds shown to be local improvement funds in the 1987 Budget be drawn from Public Works Lot Levies. The sidewalk on Sunset Boulevard which is to extend from the walkway from the Foster Creek Development to connect with the existing sidewalk system to the Newcastle Public School is firstly, related to development and, secondly, a school route. The relationship to development would result in a recommendation that Public Works Lot Levies be used to fund the portion of the project costs presented in the budget as local improvement. During recent discussions at a G.P.A.C. Meeting, come concerns were raised about the lack of sidewalks on Lambert Street on the designated school route north from Highway 2 to Church Street. The revision of the policy to allow new sidewalk construction on school routes without local improvement funding would facilitate the inclusion of such projects in future budgets without having to set up a potential conflict situation by attempting to impose construction costs on the abutting property owners when the benefit of having the sidewalk is to be realized primarily by others. i I I . ..4 Page 4 Report No. WD-43-87 In order to continue to protect the municipality from unlimited requests for new sidewalk construction, it is recommended that the theme of local improvement be maintained for all other new sidewalk construction. As part of various site plan agreements over the years, staff have been successful in negotiating contributions for up to one hundred percent (100%) of the cost of sidewalks abutting the developing site. In order to give staff support in these endeavours, it is recommended that the sidewalk 1 policy include a phrase indicating that any new development , -- expected to pay for sidewalk construction along the developing frontage.b�' �cvn(l/h G (Ttt�'-d f A copy of the existing and proposed revised version of the sidewalk policy is attached.
