REPORT NO. : WD-14-85 SUBJECT: OWNERSHIP OF INTERCHANGES CONSTRUCTED AT THE INTERSECTION WITH TOWN-OWNED ROADS AS PART OF THE HIGHWAY 35/115 RECONSTRUCTION PROGRAM. RECOMMENDATION: It is respectfully recommended: 1. That this report be received; and, 2. That the Ministry of Transportation and Communications , c/o Mr. J.G. Celmins , P. Eng., Area Manager, Planning & Design Section, Central Region, 5000 Yonge Street, Willowdale, Ontario, M2N 6E9, be advised that the Town of Newcastle is only willing to assume ownership of reconstructed and re-aligned local roads beyond what the Town considers the interchange limits, which are shaded on the attached; and, 3. That copies of this report be forwarded to the Ministry of Transportation and Communications and -the Durham Region Works Department. . . . .2 �x t Page 2 REPORT NO. WD-14-85 REPORT: Through reconstruction of Highway 35/115, within the Town of Newcastle, access from one side of the highway to the other, at intersections with local roads, has been impeded. A barrier is being constructed down the centre of the highway to separate opposing traffic and prevent vehicles from making left turns across the highway. To compensate for these restrictions, what should be considered "interchanges" have been constructed to accommodate the desired traffic moves. The attached sketch plan depicts the areas where this has occurred. Because these modifications are primarily associated with the needs of the highway, and are considered components of the interchanges, the Ministry should take positive action for their maintenance. It is not felt that the Town is either equipped or has the funds to provide the level of service which is required in such areas. Furthermore, there could be legal implications of Town-owned equipment operating within the effective limits of a facility such as Highway 35/115. . . . .3 Page 3 REPORT NO. WD-14-85 In light of the above, it is recommended that the Ministry be advised that the Town of Newcastle is interested in ownership and maintenance of local roads only beyond the limits of the shaded areas on the attached map. As a similar request by the Ministry was made to the Region of Durham, the matter has been discussed with Regional staff who have taken a similar approach. V. MITRANIC, P.ENG., MINISTRY OF TRANSPORTATION AND COMMUNICATIONS, REGARDING HIGHWAY 35%115 IMPROVEMENTS FROM MILL STREET, ORONO, TO JUNCTION OF HIGHWAYS 35 AND 115 i Recommendation A. THAT the Ministry of Transportation and Communications be advised that the Region will retain jurisdiction of Regional Road 4 up to the intersection with the Co-op Road interchange ramp and of Regional Road 9 up to the intersection with the interchange overpass road when construction is completed to the satisfaction of the Region. B. THAT a copy of this Commissioner's Report be forwarded to the Town of Newcastle. Report Attachment No. 1 - Correspondence from Mr. V. Mitranic, P.Eng. , Ministry of Transportation and Communications Attachment No. 2 - Plan of Regional Road 4-Highway 35/115 Interchange Attachment No. 3 - Plan of Regional Road 9-Highway 35/115 Interchange In W.C.-6-85, the Ministry is requesting that the Region state that it will retain ownership of reconstructed and realigned Regional roads after the construction of Highway 35/115 improvements. Only two Regional roads (Roads 4 and 9) are affected by the construction referred to in the correspondence. At present, both roads tee intersect with Highway 35/115 at signalized intersections. The reconstruction of Highway 35/115 will consist of a widening to four lanes with a continuous concrete median barrier. Left turns will be precluded even at intersection roads. All turning movements from and onto the highway will be made as right turns through interchange ramps. Intersecting roads will include direct right turn ramps and offset over/underpasses, both of which must be used by all traffic destined to the highway . D3 Page 2 Report Date February 19, 1985 Report - continued The direct right turn ramps and the offset over/underpasses are considered part of the highway interchanges and therefore, must be under the jurisdiction of the Ministry of Transportation and Communications . As a result, the Region's jurisdiction of Regional Road 4 will terminate at the intersection with the Co-op Road interchange ramp and of Regional Road 9 will terminate at the intersection with the interchange overpass road (see Attachment Nos. 2 and 3) . This Commissioner's Report has been reviewed with Town of Newcastle staff who concur with its contents and recommendations. i Recommended for Presentation to Committee D.R. Dear Sir, Re: Highway 35/115 Improvements From Mill Street to County Road 20 Thank you for your letter of January 7, 1985. Further to Council's approval of January 4, 1980, for the improvements of Highway 35/115, please note that this Ministry is in the process of completing the design and will be awarding contracts for the next few years. The contracts will include the improvement of Highways 35/115 and 115 to County Road 20. Before we can proceed any further, we require from your Municipality, an updated Resolution stating that the Municipality will retain ownership of the reconstructed and re-aligned local roads after contract completion.
