REPORT NO. : WD-17-85 SUBJECT: SUPPLEMENTARY REPORT ROAD ALLOWANCE BETWEEN LOTS 2 & 3, CONCESSION 10, FORMER TOWNSHIP OF DARLINGTON (MURPHY ROAD) RECOMMENDATION: It is respectfully recommended: 1. That this report be received; and, 2. That the recommendation in Works Department Report WD-9-85, be approved. BACKGROUND: G.P.A. Resolution 129-85, referred Works Department Report WD-9-85 back to staff to further liaise with Township of Scugog regarding the maintenance of Murphy Road and to identify all of the property owners abutting the subject road. . . . .2 ✓ �V:T Page 2 REPORT NO. WD-17-85 REPORT: The property owners abutting the portion of Murphy Road from the 10th Concession to the Boundary Road are shown on the attached sketch. They are: Mr. Harold Murphy, Lot 2, Concession 10 and Mr. Norman Hill , Lot 3, Concession 10. These properties run the full length of the 10th Concession and have access to the maintained portion of Murphy Road. In discussion with Scugog staff, it was noted that the Scugog Comprehensive Zoning By-law requires the Mitchells to have a minimum of three hundred feet (300' ) of frontage on an improved road in order to obtain residential building permits. The construction of Murphy Road would not satisfy the condition and a further three hundred feet (300' ) of road into Scugog Township or along the boundary would be required. If Committee and Council wish to approve the request of Mrs. Mitchell and ultimately the road is constructed and assumed, the maintenance of Murphy Road and the portion of the Boundary Road could be accommodated under a revised Boundary Road Agreement. However, there would be no guarantee that the neighboring municipality would continue the agreement in future years and subsequently, the responsibility for maintenance of Murphy Road would be vested in the Town of Newcastle. . . . .3 Page 3 REPORT NO. WD-17-85 Scugog staff are not prepared to recommend that they maintain any roads in the area due to the inaccessibility of the land from their own road system. Further, Scugog staff are also concerned with boundaries between mail areas, school boards, and fire departments. Special agreements between various agencies and boards would be required in order to provide these essential services. Scugog staff would recommend denial of development on the Mitchell 's property. It is, therefore, recommended that the recommendations of WD-9-85 be approved in that the request of Mrs. Lynda Mitchell be denied. Respect lly submit d, dt R.G. Dupuis, P.
