REPORT NO. : WD-21-85 SUBJECT: CERTIFICATE OF COMPLETION, PHASES I & II BURKETON HILLS ESTATES - PLAN 10R-1398 SUBDIVISION AGREEMENT REGISTERED AS INSTRUMENT NO. 112980. RECOMMENDATION: It is respectfully recommended: 1. That this report be received; and, 2. That in accordance with Clause 46 of the Subdivision Agreement between the Town and Burketon Hills Estates registered as Instrument No. 112980, the Director of Public Works be authorized to issue a Certificate of Completion for the works constructed in Phases I and II of said subdivision; and, 3. That the maintenance period for the completed works be deemed to have commenced November 6, 1984, the date of completion of said works. Such Certificate of Completion will not include surface course of asphalt. Page 2 REPORT NO. WD-21-85 REPORT: The subdivision agreement between the Town and the developers of Burketon Hills Estates made provision for various phases of works leading to completion of the subdivision. In the summer and fall of 1984, works in Phases I and II were completed with the exception of the top course of asphalt. The completed works were reviewed by Town staff in an unofficial capacity to ensure compliance with Town requirements. It is noted that they were "unofficially" reviewed and this was done due to the fact that an "Authorization to Commence" had not been issued for their construction. Due to the time involved in securing and finalizing a letter of credit, which is one of the main requirements for the Authorization to Commence, such authorization was not granted and the works were constructed at the developer' s risk. However, upon submission of the request for a certificate of completion, inspection records and records of quantity and quality were provided to the Town. As previously noted, unofficially, Town staff were reviewing the works as they progressed and the developer' s engineer did have an inspector on site at all times. The recommended Certificate of Completion would be backdated to November 6, 1984, the date of completion of the works and would not include the surface course of asphalt. With respect to the November 6th date, staff can verify satisfactory completion of the works on that date. With respect to the surface course of asphalt, normally it would be covered by one Completion Certificate. However, with development of the lots, it may be necessary to cross the pavement for hydro and telephone services which would damage the driving surface. Thus it is more desirable to delay both installation and recognition of completion of surface asphalt until a substantial portion of the lots have been built upon. . . .3 Page 3 REPORT NO.
