REPORT NO. : WD-24-85 SUBJECT: VAN ANDEL AND GUST SUBDIVISION DEDICATION OF 0.3m RESERVE ALONG THE NORTH SIDE OF MARYLEAH COURT AS PUBLIC ROAD ALLOWANCE, BLOCK 26, PLAN IOM-755 RECOMMENDATION: It is respectfully recommended: 1. That this report be received; and, 2. That a by-law be passed by Council dedicating Block 26, Plan IOM-755 as public road allowance; and, 3. That the law firm of Kitchen and Kitchen be advised of Council 's actions in this matter. . . . .2 Page 2 REPORT NO. WD-24-85 REPORT: One of the requirements in the development of the VanAndel and Gust Subdivision was the dedication to the Town of a 0.3m reserve, Block 26, Plan 10M-755. This was done since the lands to the north of Maryleah Court, shown on the attached plan, were owned by parties other than the developer. The 0.3m reserve was established to prevent access to Marleah Court from such lands. Since Maryleah Court was constructed by the developer of the Van Andel and Gust Subdivision, it would be unfair to allow owners of abutting lands free access to the road. The lands to the north have since been purchased by Van Andel and Gust and are the subject of a development agreement which is currently in progress. To allow them to be developed requires removal of the reserve. Dedication of the reserve as public road allowance is the simplest method of achieving this, therefore, it is recommended that Block 26, Plan 1OM-755 be dedicated as public road allowance by by-law. Taylor Dear Mr. Taylor: I Re: 542985 Ontario-._Limited Part of Lot 15,,,-Concession 3 , Darlington Plan 'of Subdivision '18T=84,0'21' As you are aware, the applicants for this plan of subdivision have developed the lands immediately to the south. Maryleah Court is bordered along its northern boundary by a one foot reserve. This is Block 26 on Plan 1OM-755, and it was conveyed to the Town of Newcastle in conjunction with the plan of -subdivision 1OM-755. Upon the granting of the new plan of subdivision, Lots 4 and 5 and part of Lot 3 will technically not have access to Maryleah Court. The agreement of purchase and sale for some of these lots are scheduled to be completed a short time after the plan of subdivision has been registered. Could you please take whatever steps are necessary to prepare and present the appropriate by-law to the Council for the Town of Newcastle, .which will-have the effect of dedicating Block 26 as a public highway and as part of Maryleah Court.
