REPORT NO. : WD-30-85 SUBJECT: DEDICATION OF PARTS 1 & 2, PLAN 1OR1983 IN LOTS 32-33 IN CONCESSION 2, OF THE FORMER TOWNSHIP OF DARLINGTON AS PUBLIC ROAD ALLOWANCE. RECOMMENDATION: i It is respectfully recommended: 1. That this report be received; and, 2. That Parts 1 & 2, Plan 1OR1983, be dedicated as public road allowance; and, 3. That a by-law be passed for said dedication and authorizing the Mayor and Clerk to execute the necessary documents. . . . .2 Page 2 REPORT NO. WD-30-85 REPORT: Lawyers representing purchasers of various lots on Windsor Valley Place in Courtice have discovered that the portion of the original road allowance between Lots 32 & 33, between the south limit of Nash Road and Windsor Valley Place, has never been officially opened or dedicated as public road allowance. This clouds access via a public road to their client' s lands and they would like the situation rectified. Since Windsor Valley Place as constructed through the development is located on these lands, it is recommended that the necessary dedicating by-law be passed. Respectfully submitted, l r R.G. The said land hereby established as a public highway is described as follows: ALL AND SINGULAR that certain parcel or tract of land and premises, situate, lying and being in the Town of Newcastle, in the Regional Municipality of Durham, formerly Part of Lot 33 and Part of the Road Allowance between Lots 32 and 33, Concession 2, in the former Township of Darlington, County of Durham, now in the Town of Newcastle, more particularly described as Parts 1 and 2 on Registered Reference Plan 10R-1983, deposited in -the Land Registry Office for the Registry Division of Newcastle (No. 10) on April 2nd 1985. By-law read a first and second time this 13th day of May 1985. By-law read a third time and finally passed this 13th day of May 1985.
