REPORT NO. : WD-38-85 SUBJECT: AGREEMENT WITH M.T.C. FOR RECONSTRUCTION OF BASELINE ROAD, BOWMANUILLE BETWEEN LIBERTY STREET AND DUKE STREET. RECOMMENDATION: It is respectfully recommended: 1. That this report be received; and, 2. That a by-law be passed authorizing the Mayor and Clerk to execute the agreement attached hereto, with the Ministry of Transportation and Communications for the reconstruction of Baseline Road, Bowmanville, between Liberty Street and Duke Street. 3. That the executed agreements be returned to Mr. Ken Wilson of M.T.C. accompanied by a certified copy of the above by-law. . . . .2 Page 2 REPORT NO. WD-38-85 REPORT: Report WD-1-85 attached hereto provides background to the subject proposal . The Town is reconstructing Baseline Road between Duke Street and Spry Avenue and will include the M.T.C. section between Liberty and Duke Street on behalf of the Ministry. Due to the anticipated cost of this work ($116,000) , Ministry policy requires an agreement. The attached document has been reviewed and revised according to our comments. B E T W E E N HER MAJESTY THE QUEEN, in right of e rov nce of n ar o, represented by the Minister of Transportation and Communications for the Province of Ontario, hereinafter referred to as the "Ministry", OF THE FIRST PART; and - THE CORPORATION OF THE TOWN OF NEWCASTLE, hereinafter referred to as the "Town", OF THE SECOND PART; i WHEREAS the Town intends to widen and reconstruct Baseline Road from Liberty Street to Duke Street, in the former Town of Bowmanville, Town of Newcastle, Regional Municipality of Durham, as shown on Schedule "A". attached hereto; AND WHEREAS a portion of Baseline Road is under Ministry Jurisdiction and designated as a controlled access highway hereinafter referred to as "the widening" as shown on Schedule "A" attached hereto; as i�.1�..:;✓7 ,l,;�y 6 AND WHEREAS the parties hereto agree that the Town will reconstruct the widening at the Ministry's cost and expense and the Ministry will remove the controlled access i highway designation of the widening and transfer the widening to the Town, as per the Town's Resolution �..c.T , � • E.Sos o9 #GPA-15-85 and #C-14-85 attached hereto. NOW THEREFORE THIS AGREEMENT WITNESSETH that in consideration of the premises and the covenants herein contained the Parties hereto for themselves and their respective successors and assigns agree each with the other as follows : 1 . That in this Agreement, (a) "Regional Director" means the Regional Director of the Central Region of the Ministry of Transportation and Communications, or his nominee; 2. That the Town, (1 ) shall design and prepare the contract drawings and documents required for the construction of the widening and in so doing comply with a standard mutually acceptable to the Town and the Ministry; (2) submit the contract drawings and documents for the approval of the Regional Director; i (3) allow the Regional Director at least thirty (30) days to examine and review the contract r ;�°'"'�RO V"'D cD drawings and documents; ' CPL'.?:KING AND OISIGN offict A,To T7/ (4) include in conjunction with the contract drawings and documents, IT— (a) construction and resurfacing of the f widening; is•o5'09 3 (b) curbs and gutters where required; (c) relocation of aerial or buried utilities and services subject to Ministry approval and authorized by issuance of a Ministry utility moving order; (d) illumination as designed by the Ministry; (e) grading, drainage and application of suitable vegetative cover of areas within the widening as required; (f) road name signs, warning signs and regulatory signs as required; (g) zone painting; and (h) preconstruction survey, foundation and soils investigation, pavement recommendations and road design; (5) shall prepare legal plans for any property i required to construct the widening and negotiate in consultation with the Ministry, acquisition �Mtpoli\irOh'aeV , of the APPROVED property, all at the cost and expense of °u"14'"4,�4;,°"""' the Ministry and subject to the approval of the Regional Director. 3. That the Town at the cost and expense of the Ministry T, shall prepare a plan for traffic control during the ;.. construction of the widening as set out in clause 2 °a 9.85,0S•0 F1 of this Agreement, the plan to be in accordance with the Ministry' s Manual of Uniform Traffic Control Devices and to be approved in writing by the Regional Director. 4. That the total estimated cost of the widening is the sum of One Hundred and Sixteen Thousand ($116,000.00) Dollars including surcharge: , but this is an estimate only and payment shall be made on the basis of the actual cost of the work completed by the Town for the Ministry under this Agreement and approved by Ministry inspection. 5. That from time to time the Town shall invoice the Ministry for unpaid actual cost of work under this Agreement, together with surcharges, and the Ministry shall pay to the Town the amount or amounts of each invoice within sixty (60) days of the date the Ministry receives the invoice. 6. That at least sixty (60) days prior to the commencement of the construction set out in clause 2 herein, the Town shall provide to the Ministry a written final estimate of the cost to do the work herein, receipt of the final estimate shall be acknowledged in writing by the Ministry and the Town <<m APPROVED shall construct the works as detailed in clause 2 DIANNING ANO V(SIGN OF ICI A, s/.Fmr; above. 7. That the Town shall (a) keep quantity and quality control records in form satisfactory to the Ministry, and ...�. asp os•°1 5 - (b) at all times make the quantity and quality control records available for Ministry inspection. 8. That the Ministry at the cost and expense of the Ministry shall inspect the works defined in clause 2 of this Agreement. 9. That the Town, (a) shall supervise and direct all work to the extent necessary to ensure the fulfillment of the construction contract and the completion of the work in accordance with the contract drawings and documents; (b) shall decide all questions relating to the work and construction of the work in compliance with the terms and conditions of this Agreement; (c) shall maintain in form and detail satisfactory to the Ministry records pertaining to the inspection of materials and workmanship, and M .,•"; °""� as requested make the records available for APPROVED Ministry inspection. That the surcharges mentioned in clause 4 are as follows: (a) for field engineering and supervision 10.4 per cent of the construction cost; .gs•os o, (b) for design engineering 3.7 per cent of the construction cost; and 6 _ (c) for administrative overheads 3.2 per cent of the construction cost. 11 . That when in the written opinion of the Town the work i in this Agreement has been satisfactorily completed the Town shall notify the Regional Director, the Regional Director shall cause the work to be inspected, and if the Regional Director is satisfied the work has been completed in accordance with the contract drawings and documents, the Regional Director shall give the Town written notice to that effect and thereafter the Town shall at the Town's cost and expense, be responsible for maintenance of the widening and for the supply of energy to the widening, including illumination. 12. That the Town shall indemnify and save harmless the Ministry from and against any claim, action or liability for loss, damage, accident or injury in any manner, arising due to, out of, from or in connection with the widening undertaken and performed by the Town or its agents under this Agreement. 13. REPORT NO. : WD-1-85 SUBJECT: BASELINE ROAD BETWEEN LIBERTY STREET AND DUKE STREET, BOWMANVILLE. RECOMMENDATION: It is respectfully recommended: 1. That this report be received; and, 2. That the Council of the Corporation of the Town of Newcastle resolve to accept ownership of Baseline Road in Bowmanville between Liberty Street and Duke Street once said road section has been reconstructed to a standard mutually acceptable to the Town and the Ministry of Transportation and Communications; and, 3. That a certified copy of these resolutions be forwarded to the Ministry of Transporation and Communications. . . .2 Page 2 REPORT NO. WD-1-85 REPORT: As part of the ongoing proposal for reconstruction of Baseline Road in Bowmanville, it was found that the section between Liberty Street and the Duke Street ramp to Highway 401 is under the jurisdiction of the Ministry of Transportation and Communications. Thus, early in 1984 a request was made to the Ministry to determine their desires with respect to having reconstruction of this section i included in the Town 's project. The attached reply was received from the Ministry requesting the following: 1. Type of Cross Section; 2. Traffic Signalization; 3. Preliminary costs for design and construction ; 4. A resolution from Council agreeing to assume ownership of the road. Over the past several months, the requested technical data i has been compiled and reviewed with the Ministry of Transporation and Communications. Now, in order for the Ministry to allocate the necessary funds for its share of the work, they require some assurance of the Town 's intentions. To provide such assurance and permit the matter to proceed, it is the therefore appropriate for the Town to pass a resolution as requested. . . .3 Page 3 REPORT NO. WD-1-85 Since all parties appear to have been of the belief that the section of Baseline Road between Liberty and Duke Streets was in fact a Town road, and maintenance has been performed accordingly, it is recommended that this arrangement be officially recognized through passing of the recommendations of this report. LOB 1JO - Dear Sir, Re: Baseline Road between Liberty Street and Duke Street in Bowmanville Your letter of January 30, 1984 to our Port Hope District Office was forwarded to the Central Region Planning and Design Section for our consideration and reply. We have reviewed and discussed the various aspects of your proposal and agree, in principle, that the above noted section can be reconstructed at the same time as you plan to reconstruct Baseline Road between Duke Street and Waverly Road. However, before the Ministry makes a commitment to this expenditure, the following clarification from the Town Council is required: 1. Type of Cross-Section 2. Traffic Signal Requirements 3. Preliminary Cost for Design and Construction 4. ll Resolution from the Town Council agreeing to assume ownership upon completion of the work.
