ENG., DIRECTOR TEL.(416)263-2231 987-5039 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF JULY 15, 1985. REPORT NO. : WD-48-85 SUBJECT: REQUEST FROM BECAS DEVELOPMENTS LIMITED REQUESTING PERMISSION TO CLEAR A TRAIL ON THE UNOPENED ROAD ALLOWANCE BETWEEN LOTS 18 & 19 AND IN CONCESSION 5 OF THE FORMER TOWNSHIP OF CLARKE. RECOMMENDATION: It is respectfully recommended: 1. That this report be received; and, 2. That Becas Developments Limited be granted permission to perform limited clearing of a trail on the unopened road allowance between Lots 18 & 19 in Concession 5, of the former Township of Clarke, conditional on the following: a) Prior to any clearing, all trees proposed for removal shall be marked and reviewed by the Works Department for approval . Removal of major trees will not be allowed. b) No grading or other such modifications to the road allowance will be allowed. 3. That the Works Department issue the required road occupancy permit for such activities. 4. That Mr. Peter Caspari representing Becas Developments Ltd. , be advised of Council 's actions in this matter. PP �Go B5 �,G Page 2 REPORT NO. WD-48-85 REPORT: uI- GCS) About the time Council was considering the initial approach from Mr. Walter Hengstberger for use of a road allowance in Concession 9 of the former Township of Darlington, the Works Department was approached by Mr. Peter Caspari for similar considerations pertaining to the road allowance between Lots 18 & 19, in Concession 5, of the former Township of Clarke. Mr. Caspari was advised to await the outcome pertaining to Mr. Hengstberger since his was a similar situation. Council ' s decision was conveyed to him, however, he wished to proceed with a formal request. Accordingly, this report is being presented. Although Mr. Caspari ' s letter suggests minor clearing, he has verbally indicated a desire to take actions to allow vehicular access to the lands owned by Becas Developments. The history of problems associated with such an approach is well known, therefore, no actions should be taken to allow it to proceed. In this specific case, discussions which lead to Council action took place in 1977 and a copy of the decision is attached for information. . . . .3 Page 3 REPORT NO. WD-48-85 We have no reservation about clearing of brush to facilitate access on foot to the subject lands, therefore, issuance of a road occupancy permit for this purpose would be appropriate. However, concurring with major alterations to accommodate access by cars, trucks, etc. , should be avoided especially in view of Council 's previous direction. espectfully submitted, �r -1 R.G. With reference to your recent appearance before the Public Works Committee, this is to advise you that Council adopt- ed the following, Resolution 0 W-340-77 at it 's Meeting of October 24, 1977. "THAT this Committee recommends to Council that this road bQ constructed at Mr. Caspari's expense with the condition that the road meets Town Standards and requirements and fur- ther that this Committee concurs with Report ll 76 (J. Without such path the Parcel is landlocked and can not be approached. A caveat on the title assures that the road allowance would be opened when required. At present there is no intention to develop the Parcel nor to construct a road to approved specifications . My clients did construct a pond on the property at the time they were owners of all 5 parcels of the captioned Part Lot and its personnel would like to enjoy such pond during the summer months and have the benefit of the beautiful hardwood forest located on it. It would therefore be much appreciated if you would issue the requisite occupancy permit to allow the path to be cleared of growth.
