REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE
MEETING OF SEPTEMBER 3, 1985.
REPORT NO. : WD-51-85
SUBJECT: TREE ON THE NORTH SIDE OF
( MILL STREET, HAMPTON, BETWEEN
OLD SCUGOG ROAD AND THE MILL POND
ADJACENT TO THE HIGGINS PROPERTY.
RECOMMENDATION:
It is respectfully recommended:
1. That this report be received; and,
2. That the tree on the north side of Mill Street,
Hampton, between Old Scugog Road and the Mill Pond
adjacent to the Higgins property be removed; and,
3. That Mrs. Douglas Higgins be so advised.

REPORT:
Over the past year or so there have been requests from Mrs.
Higgins to have the subject tree removed. Since a portion
of the tree overhangs her property she has constant fear
that during windy weather conditions her property may be
damaged and injury may occur. The Works Department receives
many similar enquiries and investigates them to ensure that
no danger exists. Where there is a danager in the form of
an unsound tree or limb, removal is scheduled. Where the
tree and limbs are sound we decline removal , since our
philosophy is to remove trees on the road allowance only
when they present safety problems for the driving public or
may cause damage to private property. There seems to be
little sense in removing healthy trees when in fact we
budget funds to replace trees which have been removed or to
plant them on new road construction projects.
With respect to the Higgins tree, it is considered healthy
and unlikely to fall even under severe weather conditions.
Thus, removal has not been scheduled. On this year's road
tour the area was visited and circumstances discussed with
general agreement that the tree should remain intact.

More recently, the attached correspondence, in the form of a
petition, has been directed to the Mayor supporting the
concept of removing the tree. Since there seems to be a
strong feeling that removal would be in order, it is
recommended that the request be accommodated.

Dear Mrs . Higgins:
Further to our recent conversation, I would advise that
the tree which you were concerned about was inspected during a
road tour on April 11th or lath, 1985. I was advised that staff
consider this tree to be healthy and they do not feel that this
tree is endangering your home.
I would advise you that if you consider this tree
to be dangerous to your house, that you could make a formal request
of Council , that it be cut down. With this request, you should
provide support from others who feel that this tree should come
down.
