REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE
MEETING OF SEPTEMBER 3, 1985.

SUBJECT: RELEASE OF DEVELOPMENT AGREEMENT
MARNIE INDUSTRIAL PARK LIMITED,
PART LOTS 29 AND 30, CONCESSION 1,
GEOGRAPHIC TOWNSHIP OF DARLINGTON,
R.P. # IOR-933
RECOMMENDATION:
It is respectfully recommended:
1. That this report be received; and,
2. That the Director of Public Works be authorized to

issue a Certificate of Acceptance for the works
constructed, in accordance with the Development
Agreement between Marnie Industrial Park Limited and
the Corporation of the Town of Newcastle; and,
3. That the Town Solicitor be advised to prepare the
necessary documentation for the execution and final
release of the Development Agreement; and,
4. That the Mayor and Clerk be authorized to issue the '

Certificate of Release on behalf of the Town.

REPORT:
In April , 1979, the Town of Newcastle entered into a
Development Agreement with Marnie Industrial Park Limited,
to construct an Industrial Subdivision, Lots 29 and 30,
Concession 1, in the former Township of Darlington. On
November 22, 1982 by Resolution C946-82, Council adopted
Planning and Development Report PD194-82 recommending a
Certificate of Completion be issued in accordance with the
( Subdivision Agreement. The subdivision was then placed on
two year maintenance. Minor maintenance items not performed
by the owners has delayed the issuance of a Certificate of
Acceptance. However, these items have now been resolved and
the works have been constructed and maintained in accordance
with the terms and conditions of the Development Agreement
and to the satisfaction of the Town.
The owners have indicated their compliance with the
requirements of the agreement and, therefore, request a
final release.
