SUBJECT: NO PARKING ON THE NORTH SIDE
OF THE NEWCASTLE VILLAGE
CONNECTING LINK BETWEEN NORTH
STREET AND THE POST OFFICE.
RECOMMENDATION:
It is respectfully recommended:
1. That this report be received; and,
2. That By-law 79-1, the Town of Newcastle Parking By-law,
be amended by ,eliminating parking on the north side of
the Newcastle Village Connecting Link between North
Street and a point 42 metres east of the centreline of
North Street.
3. That the petitioners be advised of Council ' s action.

REPORT:
Recently, the attached petition was received from residents
of North Street and users of the North Street/King Street
intersection, in the Village of Newcastle. The petitioners
have requested the elimination of parking in the area noted
above due to the safety hazard constituted by parked cars.
The area has been reviewed and the claims of the petitioners
found to be true. The combination of trees, street
furniture and parked cars makes visibility to the east very
difficult for southbound traffic on North Street. Factors
considered are:
1. Parked cars are closer to the driving lanes, thereby
constituting the major barrier to visibility.
2. The combination of parking setbacks from the
intersection and driveways, as well as the space
occupied by driveways themselves, eliminates a major
portion of available parking. Thus, only a few spaces
would be lost.
3. Presently, there is a two hour parking restriction in
the subject section and a fifteen minute restriction to
the east, probably to accommodate transient traffic
associated with the Post Office.
Considering our findings in reviewing this situation, as
well as the above factors, it is recommended that parking be
eliminated as requested.

BY-LAW NO. 85 -
being a by-law to amend By-law 79-1, being
a by-law to provide for the regulation of
parking and stopping on highways or parts
of highways under the jurisdiction of the
Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of
Newcastle deems it expedient to amend By-law 79-1, as
amended;
NOW THEREFORE the Council of the Corporation of the Town of
Newcastle ENACTS AS FOLLOWS:
1. That Schedule 'A' to By-law 79-1 is hereby amended by
adding thereto the following:

We the undersigned request that parking be eliminated on the north
side of King Street in the village of Newcastle from the Post Office
driveway west to North Street. The reason for thip request is that if
cars are parked in this area it is impossible to see westbound traffic
as a motorist attempts to proceed from North Street onto King Street.

Dear Mayor and Members of Council :
RE: Frontage'Charges in Courtice
The enclosed communication was given to me by the recipients,
Mr. & Mrs. Ivan Ormiston, with a request for help and advice.
The majority of the homes on this stretch of Nash Road
is below the average market price for the area and it would be impossible
for the owners to justify or raise the funds as specified.
The question of frontage charges has emerged because the Town
needs to upgrade the road to correct standards to facilitate the new
development farther east. In the fullness of time, development will
infill to the north and south of these homes which will no doubt interfere
with their wells. What will happen then if there is no water pipe on the
street below the newly constructed street? Also, most basement sump pumps
run into- the ditch. What will happen if this becomes an enclosed storm
sewer?
Once again, the tranquility of life is now seriously disturbed
on this street with the volumes of traffic and the additional worry
which the enclosed letter implies. This is in the name of progress
but at whose expense?
I would ask Council to seriously review this problem and
advise the residents of its decision.

The Town of Newcastle is considering the reconstruction of Nash

In order to avoid the subsequent disruption of the road, Durham
Region is interested in obtaining your comments regarding the
construction of a watermain and sanitary sewer in conjunction
with the road work. All of the property owners abutting your
street are being supplied with the attached information. If
there is sufficient interest in the provision of water and
sanitary sewer service, we will attempt to include the required
financing in the 1986 Budget.
This letter is intended to provide you with information to
explain the Regional costs which each property owner will face as
a result of installation of a watermain and sanitary sewer. The
attached information describes these costs under the following
headings:
1. Frontage Charges
2. Connection Charges
3. User Charges
Please note that these charges are over and above those that may
be imposed by the Town of Newcastle for any of the Works they are
considering.
I would ask that upon reading the attached information, please
complete the enclosed form and return it to us in the enclosed
stamped self addressed envelope. By obtaining your comments on
this project, we will determine whether there is a desire for
these services and be in a position to prepare the appropriate
recommendation for the Regional Works Committee and Council .

It is important that you return the enclosed form as we will
be reporting to the Works Committee on the indicated need For
the watermain and sanitary sewer and the willingness of the
affected owners to contribute frontage charges. Any owner who
does not return the form will be judged to be in opposition to
the project.
It is recognized that these charges will represent a
significant impact to all the property owners abutting Nash
Road. We are anxious to ensure you understand this
information and urge you to contact the writer or
Ms. V. .Micheaux at 668-7721 if there is any question. As
indicated, it is important that you return the enclosed form
indicating your interest in the project. Please return the
form by September 6, 1985.

SANITARY SEWER AND WATERMAIN CONSTRUCTION ON NASH ROAD
TOWNLINE ROAD TO DARLINGTON BLVD. (TOWN OF NEWCASTLE)
Due to the proposed reconstruction of Nash Road between Townline Road and
Darlington Blvd. by the Town of Newcastle, the Region of Durham is
considering the construction of a sanitary sewer and watermain in this area.
The construction of a sanitary sewer and watermain in conjunction with the road
work would be the most cost effective method of construction and would eliminate
any subsequent disruption to the road.
Prior to recommending that funds for the sanitary sewer and watermain be
included in the Region's budget, this information is being forwarded to you
to determine if you, the property owner, are desirous of these services.
The following information will provide you with an indication of the
financial implications the construction will have on you as a property
owner.
Assuming that a majority of the property owners on Nash Road indicate an
interest in the services, financing for the work will be proposed in the 1986
Budget. It is likely that this construction would take place late in 1986.
In the event that a majority of the property owners express no desire for the
services, it is very unlikely the Region will attempt to construct the works.
It 14 also very unlikely that the subject of the construction of services in
this area would be raised again in the near future.
Should the construction of these services be approved by Regional Council ,
the Region will require the abutting residents/owners to contribute toward
the cost of the work in the following manner:
1. FRONTAGE CHARGES
The construction of watermains and sanitary sewers would proceed under
the legislation provided by Section 218 of The Municipal Act. The
approval of the project on this basis would involve the passage of
Construction By-laws and By-laws to impose frontage charges on the
abutting owners. These by-laws require the approval of the Ontario
Municipal Board.
The frontage charges are based on the frontage of the property and the
Regional rates for such charges. The frontage charge rate is an average
post of constructing 6" diameter watermains and 8" diameter sanitary
sewers. These rates are revised annually to reflect the most recent
cost of construction and are used in all instances involving the
application of frontage charges throughout the Region.
This charge would be imposed on each owner following completion of the
construction and may be paid either as a lump sum amount or over a period
of twenty years for the watermain and fifteen years for the sanitary
sewer. The annual payments would be collected quarterly on the Regional
water/sewer bill .

2. Connection Charges
The Region would require each owner to pay a connection charge at the time
application is made to connect to the watermain or sanitary sewer. This
charge is payable in cash. The 1985 connection rates are quoted as Regional
Council will not he adopting the 1986 rates until late in 1985.
The rate for the connection charge is revised each year in accordance with
the costs incurred by the Region for the previous year' s installations . The
rate payable will be that in effect in the year in which application is made
to connect to the service.
The connection charge covers the cost of the connection between the
watermain or sanitary sewer and the property line. The portion of the
connection between the property line and the house or building is the
owner' s responsibility to construct and finance.
3. User Charges
Once a property is connected to the water or sewer system, the owner or
occupant is required to contribute to the maintenance and operation costs of
the systems through user charges. These charges, which are billed via the
Regional Water/Sewer bill on a quarterly basis, are dependent upon the
volume of water used.
It should be stressed that the Region does not raise any portion of the water or
sewer costs through property taxes. All charges which are imposed are normally
collected "at the time" or collected on the water/sewer bill .
The following is an example of the cost implications relative to a lot having a
frontage of one hundred (100' ) feet. The rates, used in the example, are those
in �ffect for 1985.
1. FRONTAGE CHARGES
Water
Cash Cost - 100 feet frontage @ $26.07/ft. = $2,607.00
OR
Annual Payment - 100 feet frontage @ $ 3.66/ft. = $366.00 per year for
a period of 20 years
Sanitary Sewer
Cash Cost - 100 feet frontage @ $35.20/ft. = $3,520.00
OR
Annual Payment - 100 feet frontage @ $ 5.38/ft. = $538.00 per year for
a period of 15 years

The above charges can be summarized as follows to illustrate the total costs
in the initial year of service and in subsequent years. This examole also
assumes a lot having 100 feet frontage and water usage of 50,000 gallons per
year. All charges based on 1985 rates.
