SUBJECT: GARBAGE DISPOSAL SERVICES
BOWMANVILLE URBAN AREA.
RECOMMENDATION:
It is respectfully recommended:
1. That this report be received; and,
2. That the Director of Public Works, responsible for the
collection and disposal of garbage, be authorized to
modify and alter the Bowmanville area garbage routes,
in accordance with Schedule "D" (attached) ; and,

3. That collection in accordance with revised routes
commence the week of November 11 , 1985; and,
4. That all households and commercial establishments
receiving Municipal garbage collection, be advised of
the change; and,

5. That Committee and Council reaffirm the Town' s By-law
82-184, being a by-law to regulate the collection and
removal of garbage within the Town of Newcastle; and,
6. That garbage collection and disposal from developments
governed by site plan agreement, be in accordance with
the approved development agreement.
BACKGROUND AND COMMENT:
Public Works Staff and Members of Council have been
concerned with improving the efficiency of the garbage
collection and disposal service performed by Town staff in
the Bowmanville urban area.
The present methodology and routing evolved from pre Region
days when the landfill site was close at hand. These routes
are no longer efficient and suitable for today' s operation.
Public Works staff, with the assistance of a summer Seed
Student, completed the review of the Bowmanville garbage
collection service and the following recommendations are
being proposed to improve the present system and provide a
more efficient service.

REPORT:
The present serviced area of Bowmanville includes
approximately sixty (60) downtown commercial , and 3500
residential , garbage collections. Some commercial
establishments are collected between two and four times per
week, as illustrated below:
Monday - Commercial (Downtown)
Residential - 703 units + 17 apartments
Tuesday - Commercial (Downtown)
Residential - 468 units + 50 apartments
Wednesday - Commercial (Downtown)
Residential - 738 units + 18 apartments
Thursday - Residential - 734 units + 21 apartments
Friday - Commercial (Downtown)
Residential - 828 units + 12 apartments
A review of the present system revealed that By-law 82-184,
allows unlimited quantities of refuse to be collected from
commercial establishments, once per week. By reducing the
number of commercial pick-ups per week to Monday, only, the
remainder of the week could be devoted to residential
collection.

Eliminating Monday residential pickup reduces doubling up
costs as well as advertising costs necessitated by Monday
holidays. Downtown commercial garbage would be collected on
Monday holidays as prearranged with the shopkeeper either
preceeding or following the holiday. Advertising of this
nature has recently created confusion; i .e. , the Town 's
advertisement for Labour Day and G.D.S. ' advertisement
appeared on the same page in the Statesman. Bowmanville
residents who misread the ad missed their regular collection
day.
The collection service is performed by a regular staff of
five (5), supplemented with student and part-time helpers.
The fleet consists of two (2) twenty cubic yard garbage
packers and one (1) twenty-five cubic yard packer.
Initially, the proposed routing will utilize the present
staff and fleet but is designed to have enough flexibility
to allow for more efficient, high density, one-man operated
garbage collection units. Prior to the purchase of new
equipment, immediate savings will be realized in lower
advertising costs, less travel time, and lower equipment and
labour costs. It should also be noted that the proposed
routing better satisfies the needs of the recycling program.
Upon Committee and Council ' s favourable response to this
report, all residents will be advised of the proposed
changes by the distribution of notices.

The Garbage Collection Staff have mentioned concerns with
regard to commercial and residential violations to the
Town' s Garbage By-law as follows:
Section 4(b)(iii ) Commercial collection not more than once
(1) per week.
- Pickup 2 to 4 times per week.
Section 4(c)(i ) The Town shall collect a combined total
of not more than six (6) receptacles per
collection per dwelling, etc.
- many instances, excess of 6.
Section 5(b) Liquid waste, etc, shall not be
collected.
- Containers of paint and oil are being
included in unidentifiable containers
and when run through the packer, splash
operators and spill onto the street.
Section 5(j ) Hot ashes or waste materials cabable of
starting fires are not to be collected.
- Major problem with hot ashes in winter.
Cold ashes blow into hoister's eyes.
Section 6(a) All garbage must be placed in
receptacles in accordance with
regulations
Section 6(b)(i ) Receptacles with the contents shall
weigh not more than 40 lbs.
- weight often exceeded.
Section 7(e) Brush, etc. , must be tied and no longer
than 3 ft.
- Brush is often not tied.
Section 8(d) Material for collection shall be placed
at the designated area no later than
7 :00 a.m. on the normal collection day.
- Many residents place garbage after the
truck has passed and require the unit to
backtrack.

It is suggested that most householders are not aware of the
Town ' s Garbage By-law and that a polite reminder of any
infraction would be the most effective way to advise the
householder of the problem. The following is a sample
reminder:
Dear Householder:
We are sorry to advise you that your residential garbage
will not be picked up for one or more of the following
reasons which are contrary to the Town of Newcastle' s
Garbage Collection By-law No. 82-184.
❑ Limit of 6 receptacles or bags per collection per
dwelling unit.
❑ Liquid waste shall not be collected;
Please set aside in separate marked containers or
dispose of privately. Facilities for used oil and
other liquids available at the Town of Newcastle
Works Yard on Liberty Street, South, Bowmanville.
❑ Hot ashes or waste materials capable of starting
fires.
❑ Bundles, bags or receptacles exceed 401b. weight.
❑ Brush or refuse not tied.
❑ Garbage not placed in designated area by 7:00 a.m.
❑ Improper garbage receptacles

in By-law 82-184, is appreciated.

The Public Works Department has received several enquires
and requests for garbage collection services from
units constructed under Site Plan Agreement such as
townhouses , condominium units and churches. The Site Plan
Agreement clearly outlines the responsibility for garbage
disposal and it is recommended that these conditions be
upheld until a formal application is received to amend such
Site Plan Agreement.
This report does not address all concerns with respect to
municipal garbage collection, but it is meant to establish a
new foundation for a more efficient municipal operation.
It is, therefore, recommended that the Public Works
Department be authorized to proceed with the proposed
changes to the municipal garbage routes in the Bowmanville
Urban Area.

BY-LAW NO. 82- 184
Being a by-law to regulate the handling and collection of garbage,
rubbish, ashes and other waste materials within the limits of the
Municipal Collection areas of the Corporation of the Town of Newcastle.
WHEREAS, Section 210 (83) of the Ontario Municipal Act, R.S.O. 1980, providesthat,
by-laws may be passed for establishing and maintaining a system for the collection,
removal and disposal of garbage, ashes and other refuse and for contracting and
disposal of garbage, ashes and other refuse upon such terms and conditions as may
be considered expedient:
NOW THEREFORE, the Council of the Corporation of the Town of Newcastle, pursuant
to Section 210 (83) of the Ontario Municipal Act, R.S.O. 1980, ENACTS AS FOLLOWS:-
1 . DEFINITIONS:
For the purpose of this By-Law, the following words shall have the
meaning given herein:
(a) "Garbage" shall mean all rejected, abandoned or discarded food or
table or kitchen waste material from the preparation of food, ashes,
discarded paper products, newsprint, wearing apparel , -floor sweepings,
grass clippings and garden wastes, clippings from trees and shrubs,
glass, crockery and metals.
(b) "Householder" shall mean any owner, occupant, lessee, tenant, : or any
person having use, occupation and/or charge of any dwelling, hotel ,
restaurant, apartment house, office building, public institution,
service station, industrial building, commercial premises, store,
shopping centre, or plaza or portion thereof or any other premises.
(c) "Dwelling Unit" shall mean a unit consisting of one or more rooms
designed for use as a single housekeeping establishment.
(d) "Dwelling" shall mean a detached building consisting of not more than
three dwelling units.
(e) "Food Dispensing Establishments" shall mean any restaurant, public
dining room or other eating establishment.
(f) "Commercial Premises" shall mean buildings or structures located in the
commercial zones in the Municipality of the Town of Newcastle.
(g) "Street" shall mean any public highway, road, lane, alley, square,
place, thoroughfare or way within the Town of Newcastle.

(h) "Town" shall mean the Municipal Corporation of the Town of Newcastle.
(i ) "Director of Public Works" shall mean the Director of Public Works of
the Town of Newcastle or his authorized representative.
(j ) "By-Law Enforcement Officer" shall mean the By-Law Enforcement Officer
for the Corporation of the Town of Newcastle or any other officer
authorized by the Corporation of the Town of Newcastle for the enforcement
of By-Laws in the Town of Newcastle.
(k) "Apartment Building" means a building which consists of four or more
dwelling units other than flats, but the term shall not include a group
dwelling.
2. COLLECTION AREAS
The limits of the collections areas shall be as shown on the schedules

attached to this by-law:-
Bowmanville Schedule "A"
Orono Schedule "B"
Newcastle Schedule "C"
The Properties within the limits of the collection areas which are assessed
as farmlands are excluded from the tax assessment base used to calculate the
levy for this service.
3. COLLECTOR'S RESPONSIBILITY
(a) The Director of Public Works shall be responsible for the collection and
removal of garbage by the Town.
(b) The By-Law Enforcement Officer is hereby authorized and empowered to
enforce the provisions of this By-Law.
4. COLLECTION PROCEDURE
(a) Subject to the provisions of this By-Law, the Town shall provide for
the removal of garbage.
(b) Subject to Section 4(d) , 4(e) , 6(b) and 8(b) collections shall be made
from all premises according. to the following schedule:-
(i ) From all dwellings and other premises not otherwise provided for,
not more than once (1 ) per week,
(ii ) From Food Dispensinq Establishments as follows:-
For all food dispensing establishments not otherwise provided
for, not more than once (1 ) per week.
(iii ) From Commercial and Industrial premises as follows:-
Not more than once (1 ) per week.
(c) (i ) The Town shall collect a combined total of not more than six (6)

receptacles or bundles per collection per dwelling unit or any other
premises not otherwise provided for.
( ii ) The Town shall collect a combined total of not more than four (4)
receptacles or bundles per collection per dwelling unit from
any apartment building with six (6) or more dwelling units.
( iii ) The Town shall collect any quantity of garbage per collection from
Commercial Premises or Food Dispensing Establishments, except
as hereunder provided for under Section 5.
(d) Except by order of the Director of Public Works, no garbage collection
vehicle owned, rented or operated under contract by the Town of Newcastle,
shall enter a privately owned driveway or roadway or land or other private
property for collecting garbage or other waste material . Such order shall
not be given unless it is feasible and economical for the Town to so
enter private property.
(e) Except by order of the Director of Public Works, no Town garbage collector
or contractor shall be required to enter on any private property for the
purpose of collecting garbage or other waste material .
(f) The Town may, at the request and expense of a householder, or of any
occupant of any building or part thereof, remove and dispose of garbage,
ashes or refuse, over and above the quantity specified in Section 4 at a
charge of $65.00 (Sixty-five dollars) per collection. .
5. MATERIALS NOT COLLECTED BY THE TOWN
All materials not collected by the Town shall be disposed of as directed
by the Director of Public Works and at the expense of the consignee or
owner of such materials so abandoned, condemned or rejected. The decision
of the Director fo Public Works shall be final as to quantities and
class of material to be collected.
Except as provided for in Section 10 of this By-Law, the following materials
shall not be collected by the Town of Newcastle or its contractor(s).
(a) Swill or other organic matter not properly drained or wrapped.
(b) Liquid waste and pathogenic wastes from hospitals
(c) Hay, straw or manure.
(d) Night soil and animal waste.
(e) Any material which has become frozen to the receptacle and cannot be removed
by shaking.
(f) Industrial or trade waste including any abandoned, condemned or rejected
product, or waste material , builders ' or contractors' refuse, and the stock
of any wholesale or retail merchant.
(g) Discarded truck or automobile parts , tires accessories from automotive service
service stations or similar automotive estalishments.

(h) Any material in receptacles or bundles which do not conform to Section
6(b) and 7(c) herein.
(i ) Discardedfurniture orappliances, except by special request, as set out
in Section 4(f).
(j) Not ashes or any waste materials capable of starting fires.
(k) Explosive or highly combustible materials.
(1 ) Sod, earth, tree trunks and branches,stone, building materials or
building rubbish, frozen containers, except from individual residence
and in quantities of less than 40 (forty) pounds per specified receptacle.
(m) Carcasses or parts thereof of any dog, cat, fowl or any other creature
(with exception of bona fide kitchen waste).
(n) Radioactive Material .
5. RECEPTACLES FOR GARBAGE
(a) All qarbage or other refuse to be collected by the Town of Newcastle
or its contractor(s) must be placed and kept in receptacles or containers
. in accordance with the regulations herein.
(b) (i ) Except as otherwise provided, every Householder shall provide
sufficient receptacles of not more than two (2) cubic feet
capacity which with the contents shall weigh not more than 40 (forty)
pounds, and are satisfactory to the Director of Public Works for the
deposit of garbage.
i
(ii ) Receptacles shall be covered, watertight containers, have suitable
handles, and be not more than 30 inches high or 18 inches wide.
(iii ) Non-returnable plastic bags of 2.75 cubic foot maximum capacity
with a minimum of 1.5 mil thickness and capable of being lifted
with 40 pounds of contents may also be used.
(iv) Receptacles which are smaller at the top than at the bottom,
paper boxes, 5 gallon paint cans, oil drums, lard cans and
other similar containers shall not be used unless such containers
are intended for disposal with contents and are securely closed,
covered or otherwise rendered unlikely to permit the contents to
be scattered.
(v) Grass clippings, garden waste and clippings from trees and shrubs
may be placed in returnable open baskets of at least bushel
capacity.

(b) (vi ) Every Householder shall place all such receptacles at the point
or points to be served on the days of collection as provided in
Section 8(b).
(vii ) Ashes shall be cold and shall be placed in approved containers
as specified in paragraph 6(b(ii ), Page 4.
(c) No receptacle shall be filled above the top level , and all receptacles,
except as provided for in Section 6(b) shall be provided with good
watertight covers which shall be properly placed and maintained on
such receptacles at all times, so as to prevent access by
insects or the escape of odours therefrom.
(d) Owners and Occup-*ers of Commercial premises and apartments with four
(4) or more Dwelling Units shall provide garbage storage containers
for every premises which, shall be large enough to hold the number of
receptacles as specified in Clause 4(c) which that premises would require.
These shall be approved in structure and maintenance by the Durham
Region Health Unit and placed in a location approved by the Director of
Public Works.
7. PREPARATION OF GARBAGE FOR COLLECTION
(a) Garbage must be drained of all liquid and securely wrapped before being
placed in receptacles.
(b) Such articles as crates, newspapers., packing materials,brush, bedding and
materials of like nature may be collected inalike manner as garbage, but
must be securely tied in compact bundles or parcels, not exceeding 3 feet
in any dimension or weighing over 40 pounds or placed in. sufficient
receptacles of the type specified in Section 6(b).
(c) Garden receptacles and all waste emanating from any building shall at all
times be kept on a portion of the householders' premises. All such
receptacles and waste shall be placed at such points to be served on the
days of collection as may be indicated by the Director of Public Works, in
order to facilitate collection.
(d) Such articles as bandages, poultices, dressings, medicines, vitamins,
drugs, vaccines and syringes from drug stores, medical and dental buildings
and hospitals must be securely wrapped in watertight packaging so as not
to present a hazard to collection personnel . All such bundles or parcels
must conform to weights and dimensions as provided for under Section 6(b).
(e) Brush and tree and garden and lawn cuttings shall be placed in plastic
bags or cardboard cartons securely tied, or compacted and tied in bundles
having a weight not exceeding 40 pounds and no dimension exceeding 3 feet.
8. PLACING RECEPTACLES FOR COLLECTION BY THE TOWN
(a) Collection by the Town of garbage if other waste material shall be made only
in the areas and on the days which are designated by the Director of Public
Works.

(b) Material set out for collection shall normally be placed as close as
possible to the edge of the roadway, without obstructing the roadway,
sidewalk or footpath. In any case, the Director of Public Works has the
power to designate the precise point at which the material shall be
placed for collection.
(c) Material for collection shall not be placed on a street or other public
property before 6:00 p.m. on the day preceding normal collection
(d) Material for collection shall be placed at the prescribed location for
collection not later than 7:00 a.m. on the normal collection day or pick-
up will not be guaranteed.
(e) Garbage collection service shall not be provided on proclaimed holidays,
but collection shall normally be made on the following regular business
day.
(f) Empty receptacles and all material which the collector refuses must
be removed from the street or from public property by the occupant of
the premises from which it was taken before 8:00 p.m. on the same day
that the garbage is collected or the material refused.
9. CLEAN-UP WEEK SPECIAL COLLECTION SERVICES
Special collection may be provided to Dwelling Units in the Town of
Newcastle by Resolution of Council .
10. The cost of collecting garbage, ashes and other refuse, as provided for
in this By-Law shall be charged to the benefitting property owners; that
is, the owners of property as designated in Section 2 of this By-Law and
located in collection areas as shown on Schedules "A" ,"B" and "C".
11. REPEAL OF EXISTING BY-LAWS
By-Laws 78-51,78-34 and 80-10 are hereby repealed.
12. PENALTIES
(a) The provisions of this By-Law shall not relieve any person from compliance
with any provisions of the Public Health Act or regulations prescribed by
the Medical Officer of Health.

There will be no garbage collection services on Monday,
September 2nd,1985,in the municipal area of Bowmanville:
Garbage Collection services normally provided on Monday
will be undertaken.on Tuesday,September 3rd,1985.
All garbage must be placed at curbside by 7:00 a.m,
Newspapers normally collected on Monday will be collected
the following Monday and NOT on Tuesday.
