SUB.ECT: CORRESPONDENCE FROM THE CANADIAN TRANSPORT COMMISSION REQUESTING TOWN
CONCURRENCE IN PROPOSALS TO CLOSE PUBLIC CROSSINGS AT THE CNR AND THE
UNOPENED ROAD ALLOWANCES BETWEEN LOTS 26 & 27 IN CONCESSION 1, OF THE
FORMER TOWNSHIP OF CLARKE, BETWEEN LOTS 4 & 5, IN THE BROKEN FRONT
CONCESSION OF THE FORMER TOWNSHIP OF CLARKE AND BETWEEN LOTS 10 & 11
IN THE BROKEN FRONT CONCESSION OF THE FORMER TOWNSHIP OF CLARKE.
RECOMMENDATIONS:
It is respectfully recommended:
1. That this report be received; and,
2. That the Canadian Transport Commission be advised that the Town of
Newcastle does not concur with closure of the following listed public
crossings until such time as potential users of said crossings are
given proper notice:
i ) The road allowance between Lots 26 & 27 in Concession 1 of the
former Township of Clarke and CNR Kingston Subdivision Mileage
285.66;
ii ) The road allowance between Lots 4 & 5 in the Broken Front
Concession of the former Township of Clarke and CNR Kingston
Subdivision, Mileage 279.58;
iii ) The road allowance between Lots 10 & 11 in the Broken Front
Concession of the former Township of Clarke and CNR Kingston
Subdivision, Mileage 281.13.

RE: PROPOSED PUBLIC CROSSING CLOSURES OF THE TOWN
ROAD. BETWEEN LOTS 4 & 5 BROKEN FRONT CONCESSION
AT MILEAGE 279 . 58 KINGSTON SUBD. , CNR AND SAMIS
ROAD AT MILEAGE 281 . 13 KINGSTON SUBD. , CNR.
BOTH WITHIN THE TOWN OF NEWCASTLE.
CTC FILES: 26711 . 2526 & 26711. 2528 .
Reference is made to a joint site meeting held on May 23 , 1985
between this Office ' s Regional Engineer, Mr. C. Stephens, the
CNR representative, Mr.L.Bovay and your Municipal representative.
As discussed, the Town of Newcastle is requested to advise
whether they will consider closing the aforementioned crossings.
In order to assist you in making the decision of whether or not
to close the crossings the following information is included.
1 . The road authority would revert the road to "unopened road
allowances" .
2 . If and when these road are needed, the junior party, in
this case, CN Rail, would be responsible for all costs .
These costs would include, the crossing surface and any
protection deemed necessary at the time of installation.

3 . The cost of future maintenance would also be paid,
solely by the junior party C.N.Rail.
4 . The procedure for the re-opening of said crossings would
be an application ( letter) and plan to the Railway
Transport Committee.
