RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-275-87 be received; and
2. THAT the by-laws and schedules attached hereto be approved.
BACKGROUND AND COMMENT:
On August 21, 1987 the Planning Department received an application submitted by
Kingsberry Properties Limited requesting the removal of the "(H) Holding" symbol
provision on various parcels of land located within Part of Lot 35, Concession 2,
former Township of Darlington relating to Land Division Committee applications (see
attached).
As Committee is, no doubt, aware the "Holding" symbol shall be removed upon Council
being satisfied that the uses to be permitted will be adequately serviced, the lands
to be used have adequate access, prior uses of the land will not prevent the use of
the land for the purposes intended by the by-law, that the lands and proposed uses
will be adequately protected from any physical or manmade hazards and conditions
associated with the lands, and that the agreements in respect of such matters and the
associated financial requirements, where required, have been executed with the Town
of Newcastle and/or the Regional Municipality of Durham.

As previously noted, the application as filed by Mr. Mark Foley on behalf of
Kingsberry Properties, requested the removal of the "Holding" symbol from
various parcels of land within Part of Lot 35, Concession 2, former Township of
Darlington. These parcels were created by consent and as a condition of this
approval, the requirements of the Town of Newcastle had to be fulfilled. The
proposed lots are back lots to be developed in conjunction with Plan of
Subdivision 10M-781 (Remlark Holdings). Staff would note that the conditions
as imposed through the Land Division Committee consideration of each
application have been satisfied to the Town's satisfaction with the exception
of the removal of the 0.3 Metre Reserve, where applicable, and the removal of
the "Holding" symbol affecting the parcel.
It is noted for the Committee's information that in respect of each
application, the Region of Durham Planning Department and Works Department
provide individual comment to the Land Division Committee listing their various
conditions of approval. It is anticipated that, notwithstanding the removal of
the "Holding" symbol, each application will require the clearance of the
appropriate conditions; be they financial or otherwise, before the Land Division
Committee would consider the applications approved and finalize the necessary
deed documents.
In consideration of the above comments, Staff would have no objections to the
removal of the "Holding" symbol as shown on the attached by-law and schedules
hereto. It is noted for the Committee's information that a number of the Land
Division Committee applications for which the removal of the Holding symbol was
requested, require the fulfillment of all conditions prior to November 20,
1987. It is acknowledged that should Committee and Council deem it appropriate
to approve the application as requested, Staff would be in a position to
provide the clearance letters prior to the above-noted date.
Staff would note for Committee's information that pursuant to Section 35 of the
Planning Aet, a by-law amendment to remove the (H) Holding symbol is not
subject to the normal appeal period afforded a standard rezoning application

BY-LAW NUMBER 87-
being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law of
the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
advisable to amend By-law 84-63, as amended, of the Corporation of the Town
of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Town of Newcastle enacts as follows:
1. Schedule "4" to By-law 84-63, as amended, is hereby further amended
by changing the zone designation from "Holding - Urban Residential Type One
((H)R1)" to "Urban Residential Type One (R1)" Zone as shown on the attached
Schedule "X" hereto.
2. Schedule "X" attached hereto shall form part of this By-law.
3. This By-law shall come into effect on the date of passing hereof,
sub,lect to the provisions of Section 35 of the Planning Aet.
