SUBJECT: REZONING APPLICATION - SOUTHLAND (7-11)
PART LOT 11, CONCESSION 1, B04dMANVILLE - 180 KING STREET EAST

ONTARIO MUNICIPAL BOARD HEARING - NOVEMBER 16, 1987
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-264-87 be received; and
2. THAT the Town's Solicitor be authorized to attend and represent the
Municipality's interest at the Ontario Municipal Board Hearing to be
convened on November 16, 1987 in respect of application for rezoning file
DEV 86-77.
BACKGROUND AND COMMENT:
The General Purpose and Administration Committee at their meeting of April 6, 1987
in consideration of an application filed by Southland Canada Incorporated
(7-eleven) on behalf of Shell Canada Products Limited, forwarded a recommendation
to Council that the rezoning application, to permit the development of a
convenience food store-gas bar, be denied. Council, at their subsequent meeting of
April 13, 1987, approved the following recommendation:

That Report PD-82-87 be received; and
That the application for rezoning submitted by Southland Canada
(7-eleven) on behalf of Shell Canada Products Limited to rezone the
subject lands to permit a convenience store be denied.
In consideration of Committee and Council's decision, an appeal to same was
submitted by the applicant. To that end, an Appointment of Hearing has been
scheduled for November 16, 1987.
In consideration of same, Staff feel it would be appropriate for the Town's
Legal Counsel and any necessary Staff to attend the Hearing in support of
Council's decisions.
