SILVA (VENTURY HOMES) PART LOT 16, B.F.C., FORMER TWP. OF DARLINGTON (OUR FILE: DEV 86-85) RECOP~IENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-252-87 be received; and 2. THAT the Ministry of Natural Resources be advised that the Town of Newcastle has no objections to a change to the Flood Standard for the Darlington Creek from the Regional Storm to the 1:100 Year Flood in accordance with established procedures, and hereby request the Ministry to approve same; and 3. THAT the applicant be so advised. BACKGROUND AND COMMENT: At the General Purpose and Administration Committee Meeting held on Tuesday, September 8, 1987, the following resolution was forwarded to Council for their consideration. "1. THAT Report PD-21~-4-87 be received; and 2. THAT Staff initiate an application to the Ministry of Natural Resources in accordance with established procedures to change the Flood Standard for the Darlington Creek from the Regional storm to the 1:100 Year Flood; and ...2 ~~~> REPORT NO.: PD-252-87 PAGE 2 3. THAT the necessary Public Meeting be advertised and scheduled for the October 5, 1987 meeting of the General Purpose and Administration Committee." In consideration of the above-noted resolution and the requirements of the Ministry of Natural Resources requiring a general Public Notice, Staff would advise that the appropriate news advertisement was placed in the Canadian Statesman on September 16, 1987. As confirmed within Staff Report PD-214-87, the Conservation Authority requested the applicant to undertake a Watershed Study to establish the 1:100 Year Floodline for the Darlington Creek. Staff would note that within the context of the Darlington Creek Floodplain Study, the Study was to determine: 1) the impact of development on upstream flood levels; 2) the impact of utilizing storage upstream of the CNR to reduce the Regulatory and 1:100 Year flood levels; 3) to determine the affect of Darlington Creek flood levels on the property east of that owned by Darlington Wood Products. The summary and conclusions of said report indicated that the 1:100 Year flood level for Darlington Creek at the proposed site was established at 267.7 feet. The storage upstream of the CNR would not significantly lower the regulatory flood level. Additionally, the placement of fill would not significantly raise the regulatory flood level. The maximum increase established as only .~ feet (5 inches). Fourthly, the property located to the east of Darlington Wood Products during the 1:100 Year flood would not be flooded by run-off from Darlington Creek. It appears from discussions with the Central Lake Ontario Conservation Authority that they are prepared to accept the Study and its recommendations subject to approval by the Ministry of Natural Resources of the change in the regulatory flood for this watershed. In consideration of the above-noted comments, Staff would have no objections to the proposed change to the Regulatory Flood Standard for the Darlington Creek. Should Committee deem it appropriate to endorse the above-noted resolution, Staff would note that, pending the approval of the change to the Regulatory ...3 ~~~ REPORT NO.: PD-252-87 PAGE 3 Flood Standard by the Ministry of Natural Resources, the rezoning application submitted by Mr. Silva (PD-251-87) to permit the development of said lands, would be further evaluated and forwarded to Committee for consideration.
