RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-254-87 be received; and
2. THAT the by-law, attached hereto as Attachment No. 1, to amend By-law 84-63
to rezone the lands subject of Rezoning Application DEV 85-19, be forwarded
to Council for approval; and
3. PURSUANT to Section 34(16) of the Planning Aet, Council resolves that
further notice is not required in respect of the revised by-law.
BACKGROUND AND COMMENT:
On December 1, 1986, Committee resolved (Resolution ~~GPA-1100-86) to approve
Rezoning Application DEV 85-19 (Townline Estates) and to forward a by-law to
Council when Official Plan Amendment Application 85-30/D is approved by the Region
of Durham and Subdivision Application 18T-85018 is draft approved. The Official
Plan Amendment was approved as Amendment No. 165 by Regional Council, and
subsequently approved by the Ministry of Municipal Affairs on March 16, 1987. The
Subdivision plan was draft approved by the Region on June 3, 1987.

The draft Zoning By-law approved in principle by Committee related to a revised
Plan of Subdivision dated October 28, 1986. On January 15, 1987, the Region
circulated the Town a further revision of the Townline Estates Subdivision Plan,
dated January 7, 1987. This revision was necessitated by comments from the
Ministry of Natural Resources objecting to the October 28, 1986 plan which
indicated the rear lot lines of Lots 34 to 48 encroaching into the Farewell Creek
valley. The Ministry indicated that, as a result of negotiations with the
developer, it had been agreed that the rear lots of the lots abutting the valley
would correspond with the top of bank. The revision dated January 7, 1987 and
which was ultimately draft approved indicates the subject rear lot lines as being
located along the top of bank. Therefore, the draft by-law approved in principle
by Committee does not relate to the Plan which was draft approved. The provisions
of the "Residential Estate (RE)" zone have been amended by By-law 87-18 which was
approved by Council on January 26, 1987. As well, the Conditions of Draft Approval
specify that the valleyland blocks shall be conveyed to the adjacent lots, thereby
bringing the lot areas for all lots in the subdivision above the minimum 4800 sq.m.
area required by the "RE" zone.
Staff note that Council, at its meeting of July 27, 1987, resolved (Resolution
~~C-675-87) to advise developers that all future development in Courtice will be put
on hold until the matter of well water disruption has been resolved. Staff have
interpreted this resolution to apply only to development applications within the
Courtice Urban Area.
Accordingly, Staff have prepared a new by-law attached hereto as Attachment No. 1,
which rezones the lands subject of Rezoning Application DEV 85-19 to "Residential
Estate (RE)" and the valleyland blocks to "Environmental Protection (EP)". It is
recommended that said by-law be fowarded to Council for approval.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 87-
being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law of
the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
advisable to amend By-law 84-63, as amended, of the Corporation of the Town
of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Town of Newcastle enacts as follows:
1. Schedule "1" to By-law 8~4-63, as amended, is hereby further amended by
changing to "Residential Estate (RE)" and "Environmental Protection (EP)", the
zone designations of the lands indicated as "ZONE CHANGE TO RE" and "ZONE CHANGE
TO EP" on the attached Schedule "X" hereto.
2. Schedule "X" attached hereto shall form part of this By-law.
3. This By-law shall oome into effect on the date of passing hereof,
subject to the provisions of Seetipn 35 of the Planning Aet.
