SUBJECT: SUMMARY OF COMMITTEE OF ADJUSTMENT APPLICATIONS
FOR THE MEETING OF SEPTEMBER 9, 1987
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD®245®87 be received for information.
BACKGROUND AND COMMENT:
For the information of the General Purpose and Administration Committee, Staff have
prepared the attached list of applications to the Committee of Adjustment for the
meeting of September g, 1987• This list includes the file number, applicant's
name, site location, type of variance requested, Official Plan conformity, By-law
conformity, Staff's comments on the applications, and the Committee of Adjustment's
decision.

APPLICATIONS:
A 67/87 - William & Marilyn Jarnes, Lot 19, Concession 5, Darlington.
Application was made for relief from zoning by-law requirements in
order to permit the applicant to create a lot with a frontage of
25.83 m, instead of the required 30 m frontage and an area of 2580
sq. m, instead of the required 3000 sq. m.
Mr. and Mrs. James appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by Mrs. Payne, seconded by Mr. Barrie,
"THAT the requested variance would not appear to offend
the intent of the Official Plan or Zoning By-law or
have a detrimental effect on the surrounding neighbour-
hood and would appear to be an infilling situation, there-
fore the variance would appear to be minor in nature and
permission is GRANTED to create a loti with a frontage of
25.83 m and an area of 2580 sq. m".

Application was made for relief from zoning by-law requirements in order
to permit the applicant to continue the construction of a single family
dwell7ng~~ with a side yard of .03 m, instead of the required 1.2 m side
yard.
Mr. George Smith and Mr. Grander appeared in support of this application.
Mr. Ron Strike appeared on behalf of abutting property owner, Mr. Bugden,
in opposition to the application. No other person appeared in support
of or in opposition to this application.
Moved by Nir. Murdoch, seconded by Mr. Reicheld,
"THAT due to the fact the footings,~aves, weeping tiles,
drainage spouts, hydro meters etc. would appear to be
encroaching onto the abutting lots and a variance of
.03 m would not permit the necessary access to undertake
any maintenance on the south wall of this dwelling unit,
this variance would appear to have an adverse effect on
the abutting property and the variance cannot be consid-
ered minor and is therefore DENIED."

A 69/87 - Neale & Shirley McLean, Lot l0, Conc. 2, Bowmanville.
Application was made for relief from zoning by-law requirements in order
to permit the applicant to construct a two storey accessory building
having a total floor area of 1608 sq. ft., instead of the required not
more than 40% of the main building total floor area and having a height
of 18 ft. (5.48 m), instead of the required not more that 5 m in height.
Mr. & Mrs. McLean appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by Mr. Rehder, seconded by Mr. Murdoch,
"THAT as the requested variance would not appear to
offend the intent of the Official Plan or Zoning By-
law or have an adverse effect on the surrounding
properties and due to the size of this lot and the
location of the accessory building on the lot this
variance is considered minor and permission is GRANTED
to construct an accessory building having a height of
18 ft. (5.48 m). This variance is conditional that
the loft is NOT USED as a habitable room."

Application was made for relief from zoning by-law requirements in order
to permit the applicant to construct a 1200 sq. ft .' accessory building
which would exceed the maximum requirement of not more than 40% of the
main building total floor area.
Mr. Scarr appeared in support of this application. Mr. & Mrs. Racansky
appeared in opposition to this application. No other person appeared
in support of or in opposition to this application.
Moved by Mr. Barrie, seconded by Mr. Rehder,
"THAT the requested variance of this size would not
appear to conform with the intent o-~the Zoning By-
law or Official Plan and can not be considered minor.
However, a smaller accessory building having 720 sq.ft.
could be considered minor and is therefore GRANTED."

A 71/87 - Barbara & Kitt Klawitter, Lot 18, Conc. 3, Darlington
Application was made for relief from, zoning by-law requirements in order
to permit the applicant to create a lot with a frontage of 8 m, instead
of the required 30 m frontage.
Mr. & Mrs. Klawitter appeared in support of this application. No
other person appeared in support of or in opposition to this application.
Moved by Mr. Murdoch, seconded by Mr. Barrie,
"THAT as the requested variance would not appear to
offend the intent of the Official Plan or Zoning By-law
or have an adverse effect on surrounding properties, and
as a frontage of 8 m would allow access to the larger
parcel at the rear where the house is located, this
variance is considered minor in nature and permission
is GRANTED to create a lot with a frontage of 8 m. This
variance is conditional upon the applicant having
registered on title a perpetual right-of-way which
provides legal ingress and egress to an improved public
street."

Application was made for relief from zoning by-law requirements in order
to permit the applicant to continue the construction of a single family
dwelling leaving a 4.8 m exterior side yard, instead of the required
6.0 m exterior side yard.
Mario Veltri appeared in support of this application. No other person
appeared in support of or in opposition to this application.
Moved by Mrs. Payne, seconded by Mr. Murdoch,
"THAT as the requested variance would appear to conform
with the intent of the Official Plan and Zoning By-law
and would not have an adverse effect on the surrounding
neighbourhood and as the dwelling has a front yard set
back of 8.0 m, this variance is considered minor in
nature and permission is GRANTED to continue the con-
struction of a single family dwelling having an exterior
side yard of 4.8 m."

Moved by Mr. Reicheld, seconded by P1rs. Payne,
"THAT Application A 57/87 be amended to read:
'THAT as the requested variance would not appear to
offend the intent of the Zoning By-law or Official Plan
and would not appear to have a detrimental effect on the
surrounding neighbourhood, this variance is considered
minor in nature and permission is GRANTED to construct a
528 sq. ft. accessory building, thus making a total of
608 sq, ft. (56.5 sq.m) including the existing accessory
building'

"THAT Application A 60/87 be amended to read:
'THAT as the requested variance would not appear to
offend the intent of the Official Plan or Zoning By-
Law and would not appear to have a detrimental effect
on the surrounding neighbourhood, the variance is
considered minor in nature and permission is GRANTED
to construct a 468 sq. ft. accessory building.'
