It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-241-87 be received; and
2. THAT the rezoning application submitted by Bill Van Der Herberg on behalf of Knox
Christian School to permit the severance of an existing residence from the abutting
school grounds be approved and that the attached by-law be forwarded to Council for
approval.
BACKGROUND AND COMMENTS:
On July 22, 1987 the Planning Department received an application from Mr. Bill Van Der
Flerberg, the agent for Knox Christian School to permit the serverance of an existing
residence from the abutting school grounds of Knox Christian School in Part Lot 14,
Concession 2 in Bowmanville.
Within the Town of .Newcastle Comprehensive Zoning By-law 84-63, as amended, the subject
lands are zoned as "Urban Residential Exception (R1-10)". This zoning provides lands to
be used solely for the purposes of a private school, and does not recognize a residential
dwelling as a permitted use.

Staff would note for the Committee's information that the applicants had
previously submitted a land severance application in 1980 (LD 169/80) 'For
which approval was granted. However the conditions of severance were not
fulfilled and the approval has expired. The subject lands were zoned to
recognize the private school and included the dwelling unit as it was
located on the total holdings.
As stated above, an application for land severance has been submitted by
Knox Christian School (LD 591/87) and has been given approval conditional
upon the rezoning being final and binding. Staff would note that the
appropriate road widening would be required as a condition of the
rezoning and Land Division application.
Staff would note for the Committee's information that, pursuant to
Council's resolution of July 26, 1982 and the requirements of the
Planning Act, the appropriate signage acknowledging the application was
installed on the subject lands.
In accordance with departmental procedures the application was circulated
to obtain comments from other departments and agencies. In summary, the
following agencies offered no objections.
Town of Newcastle Community Services Department
Town of Newcastle Building Department
Town of Newcastle Public Works
Town of Newcastle Fire Department
Durham Regional Planning Department
Durham Health Unit
Newcastle Hydro Electric Commission
Central Lake Ontario Conservation Authority
The Town of Newcastle Community Services, in responding requested a 5%
cash-in-lieu of parkland dedication however inasmuch as the land
severance is to recognize an existing dwelling, the requirement is not
applicable.

The Town of Newcastle Public Works Department, in reviewing the
application, requested that an appropriate road widening be dedicated to
the Town.
In consideration of the above, Staff would have no objection to the
rezoning of the lands as submitted.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 87-
being a By-law to amend By-law 84-63, the Comprehensive Zoning
By-law of the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 84-63, as amended, of the Corporation of
the Town of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of
the Town of Newcastle enacts as follows:
1. Schedule "3" to By-law 84-63, as amended, is hereby further
amended by changing the zone designation from "Urban Residential
Exception (R1-10)" to "Urban Residential Type One (R1)" as shown on
- the attached Schedule "X" hereto,
2. Schedule "X" attached hereto shall form part of this By-law.
3. This By-law shall come into effect on the date of passing ~.,
hereof, subject to the provisions of Section 35 of the Planning Act.
