SILVA (VENTURY HOMES) PART LOT 16, B.F.C., FORMER TWP. OF DARLINGTON REMOVAL OF "(H) HOLDING SYMBOL RECOMMENDATIONS: It is respectfully recommended to Council the following: 1. THAT Report PD-243-87 be received; and 2. THAT the application submitted by J. Silva to permit the construction of a manufacturing facility and associated sales office, located on Part of Lot 16, Broken Front Concession, former Township of Darlington, be approved in part and that the attached by-law, thereby removing the "(H) Holding" symbol from the easterly portion of the subject lands be approved. BACKGROUND .AND COMMENT: As noted within Report PD®227-87, submitted for Committee's consideration at their September 8, 1987 Meeting, the Planning Department received an application for rezoning and site plan approval submitted by J. Silva to rezone a parcel of land located within Part of Lot 16, Broken Front Concession, former Township of Darlington. The purpose of the rezoning and site plan applications was to permit the construction of a manufacturing facility and associated sales office. In consideration of the intent and scale of the rezoning application and through the review of the appropriate files, it became apparent that the current floodplain ...2 REPORT NO.: PD-243-87 PAGE 2 regulations which affect the property would significantly impact the applicant's proposal. In consideration of the application, the Conservation Authority, as noted within Staff Report PD-214-87, requested the applicant to undertake a Watershed Study to establish the 1:100 Year Floodline for the Darlington Creek. This Study has been completed and indicates that a 1:100 Year Floodplain would free up a signficant portion of the property for development. It appears from discussion with the Central Lake Ontario Conservation Authority that they are prepared to accept the Study and its recommendations subject to approval by the Ministry of Natural Resources of a change in the regulatory flood for this watershed. Staff would note that a Public Meeting has been scheduled for October 5, 1987 to consider the rezoning application as well as a Public Meeting to obtain input in respect of the proposed change to the regulatory flood for the Darlington Creek. Staff would note for the Committee's information that the applicant, notwithstanding the above comments, has revised the Site Plan application, as submitted, thereby relocating the associated office use fully within the "(H)M1" Industrial zone. Inasmuch as a Development Agreement has been completed thereby acknowledging the revised site plan and location of the office use, Staff would have no objection to the removal of the (H) Holding symbol in part, as illustrated on the attached by-law thereby permitting the applicant to commence construction of the office facilities. Staff would note that the Public Meeting scheduled for October 5, 1987 in respect of the zoning by-law amendment affecting the Environmental Protection Zone and the proposed change to the regulatory flood standard for the Darlington Creek will, pending receipt of approval, finalize the location of the proposed manufacturing facilities. In addition to the above comments, Staff would note ...3 REPORT NO.: PD-243-87 PAGE 3 the Development Agreement contains the necessary provisions acknowledging the requirements for approval of the rezoning application and change to the regulatory standards for the Darlington Creek.
