FOR THE MEETING OF OCTOBER 29, 1987
RECOMl~IEtdDATIONS:
It is respectfully recommended that the General Purpose and .Administration
Committee recommend to Council the following:
1. THAT Report PD-293-87 be received for information.
BACKGROUND AND COMMENT:
For the information of the General Purpose and Administration Committee, Staff have
prepared the attached list of applications to the Committee of Adjustment for the
meeting of October 29, 1987. This list includes the file number, applicant's
name, site location, type of variance requested, Official Plan conformity, By-law
conformity, Staff's comments on the applications, and the Committee of Adjustment's
decision.

APPLICATIONS:
A 75/87 - Ronnie Wassler, Lot 35, Conc. 2, Darlington.(Lot 10 10M781)
Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct an above ground deck and
spa, leaving a side yard of 4.2 inches (.10m)
Mr. Wassler appeared in support of this application. Mr. & Mrs.
Langille submitted a letter in objection to this application. No
other person appeared in support of or in opposition to this
application.
Moved by Mr. Herring, seconded by Mr. Reicheld,
"THAT as the variance in side yard is not considered
to be minor in nature and as the neighbour's privacy
would be compromised with a structure of this height
and proximity to the side yard, the application to
construct an above ground deck and spa is DENIED"

Committee of Adjustment Meeting, October 29, 1987.....
A 79/87 - Douglas P. Dryer, Lot 7, Conc. B.F., Darlington
Application was made for relief from zoning by-law requirements in
order to permit the applicant to construct a 700 sq. ft. addition to
the existing legal non-conforming cottage, located within an
Environmental Zone.
Mr. Dryer appeared in support of this application. No other person
appeared in support of or in opposition to this application.
Moved by Mr. Murdoch, seconded by Mr. Herring,
"THAT as the requested variance would not appear to
offend the intent of the Official Plan or Zoning By-
law or have a detrimental effect on the surrounding
properties, this variance is considered minor in nature
and therefore permission is GRANTED to construct a 450
sq. ft. addition to the existing cottage. This variance
is conditional upon approval of C.L.O.C.A. and the
Ministry of Natural Resources."

A 80/87 - J D. Barnes, Surveyor, Lot 8, Conc. 1, Bowmanville
Application was made for relief from zoning by-law requirements in
order to permit the appliant to continue the construction of a single
family dwelling, leaving a rear yard of 7.14 m, instead of the
required 7.5 m rear yard.
Mr. Dennis Wheeler appeared in support of this application. No other
person appeared in support of or in opposition to this application.
Moved by Mrs. Payne, seconded by Mr. Herring,
a
"THAT as the requested variance does not appear to offend
the intent of the Official Plan or Zoning By-law or have
a detrimental effect on the surrounding properties, this
variance is considered minor and permission is GRANTED to
continue the construction of a single family dwelling,
leaving a rear yard of 7.14 m."

Committee of Adjustment Meeting, October 29, 1987....
A 81/87 - David Stanley & Robin Elaine Fuller, Lot 28, Conc. 1, Village
Application was made for relief from zoning by-law requirements in
order to permit the applicant to create a lot with a frontage of
17.46 m, instead of the required 18 m frontage.
Mr. Fuller and Mr. Lycett appeared in support of the application. A
petition was received from neighbours in opposition to the
application and several of the neighbours, including Mr. Alldread and
Mr. Sheer appeared in opposition , objection to the condition of the
road and the added traffic with an additional dwelling. No other
person appeared in support of or in opposition to this application.
Moved by Mr. Reieheld, seconded by Mr. Murdoch,
"THAT as the requested variance would appear to conform
with the intent of the Official Plan and Zoning By-law
and as the creation of this lot would be an infilling
situation and therefore not have a detrimental effect on
the surrounding properties, this variance is considered
minor and permission is GRANTED to create a lot with
17.46 m frontage."

OTHER BUSINESS:
Mr. Edwards discussed with the Committee the replacement of the
Secretary of the Committee.
Moved by Mr. Reieheld, seconded by Mr. Barrie,
"THAT Mr. Edwards prepare an advertisement, for a
Secretary, to be placed in the local papers, review
such applications and then submit to the Committee
the most suitable applicants."

Moved by Mr. Rehder, seconded by Mrs. Payne,
"THAT the Committee accept the resignation of Carrol
Clemens, as Secretary of the Committee of Adjustment"
"CARRIED"
Moved by Mr. Herring, seconded by Mr. Rehder,
"THAT the minutes of the last meeting be approved as
circulated"
