THE CORPORATION OF THE TOWN OF NEWCASTLE
BY -LAW NUMBER 82- 45
being a By -law to authorize the entering into of an Amending
Development Agreement with Stewart D. Preston.
The Council of the Corporation of the Town of Newcastle hereby enacts
as follows:
1. THAT the Mayor and Clerk are hereby authorized to execute on
behalf of the Corporation of the Town of Newcastle, and seal with the
Corporation's seal, an Amending Development Agreement between
Stewart D. Preston and the said Corporation dated the 15th day of
March, 1982, in the form attached hereto as Schedule "V.
2. THAT Schedule "X" attached hereto forms part of this
by -law.

AMENDING DE ELOPMENT AGREEMENT made (in quintuplicate) this
day of /XtC_i , 1982.
BETWEEN:
-and -
STEWART D. PRESTON
hereinafter called the 'OWNER" OF THE FIRST PART
THE CORPORATION OF THE TOWN OF NEWCASTLE,
hereinafter called the "TOWN" OF THE SECOND PART
WHEREAS the Owner warrants that it is the registered owner of those
lands described in Schedule "A" attached hereto and hereinafter
referred to as the "said lands ";
AND WHEREAS the Town has passed By -law 80 -146 and the Owner and the
Town have entered into a Development Agreement which was duly
executed by the parties thereto;
AND WHEREAS the parties hereto agree to amend the said Development
Agreement;
NOW THEREFORE in consideration of the mutual agreements, covenants
and provisoes contained herein, the parties hereto agree as follows:
1. Paragraph 3 of the Development Agreement authorized by By -law
80 -146 between Stewart D. Preston and The Corporation of the Town of
Newcastle is hereby amended by the addition of the following
sentence: "Notwithstanding the foregoing, the Owner further agrees
to complete the final surfacing of the parking area shown on Schedule
"C" with concrete or bituminous asphalt on or before April lst,
1984.

THIS SCHEDULE IS SCHEDULE "A" to the AMENDING AGREEMENT which has
been authorized and approved by By -law Number 82-1�4'-'r_ of the
Town of Newcastle enacted and passed the i-3 7-'�_ day of
1982.
LEGAL DESCRIPTION OF SAID LANDS
ALL AND SINGULAR that certain parcel or tract of land, situate, lying
and being in the Town of Newcastle, in the Regional Municipality of
Durham, and being composed of Part of Lot 21, Concession 2 in the
Geographic Township of Darlington, in the Region of Durham, and now
described as Parts 2 and 4 on a registered reference plan, deposited
in the Registry Office, Division of Newcastle (NO. 10) as plan
1OR -1190.
