HomeMy WebLinkAbout67-10THE CORPORATION OF THE VILLAGE OF NEWCASTLE BY —LAW 67-10 Being a By-law concerning Ambulance Service. WHEREAS Ambulance Service Act, Statutes of Ontario 1966 Chapt. 7, Sec. 3(b) authorizes the Council of a Municipality to enter into an agreement with another Municipality to maintain and operate an Ambulance Service. AND WHEREAS the Council of the Village of Newcastle passed a resolution on April 10, 1967 authorizing the Reeve and Clerk to sign such an agreement which they did sign. NOW THEREFORE the Council of the Corporation of the Village of Newcastle enacts as follows: That the Resolution of Council passed on April 10, 1967 authorizing the Reeve and Clerk to sign an agreement Schedule "All attached, with the Town of Bowmanville and Townships of Clarke and Darlington for the provision of Ambulance Service, be hereby ratified. All By-laws inconsistent with this 3y-law be and are hereby repealed. OF THE FIRST PART - AND - The Corporation of the Township of Darlington, in the County of Durhwa, hereinafter called "Darlington Townships". OF THE FOURTH PART WHE'�EAS the parties hereto desire to set down the terms of an agreement between them for the provision of Ambulance Service for the purpose of conveying persons suffering from disease or accident to a hospital or other place and in particular as such service may be for the benefit of the people of the Town of Bowman -rifle, Toieiship of Darlington, Township of Clarke and the Village of Newcastle.' THEREFORE in consideration of the mutual terns, covenants and agreements herein made and contained, the parties hereto agree as follows: 1) That the Town shall enter into an agreement with Donald W. Harvey, Ambulance Operator, to provide ambulance service j for all the people of the Town of Boca.a.nville, the Township of Darlington, the Township of Clarke, and the Village of Newcastle under such terms and conditions as set out therein. r" i 2) The terms of this agreement shall commence on the First day of January, 1967 and continue for two years until the Thirty -first day of December, 1968 and subjept to the r . ht l by either of the parties to t d atc the agreement at,the 1 �a e r � tt 2 end of any calendar month upon sixty days written notice and subject also to this agreement being terminated without notice upon termination of the agreement between the Town of Bowmanville and Donald 11% Harvey. 3) The Town shall pay the Ambulance Operator on the basis of A0,$00 per year by monthly instalments of $900 at the end of each month until the termination of the agreement. The. Corporation of the Town of Bowr anville, the Township of Darlington, the Toynship of Clarke and the Village of Newcastle shall share in the annual cost of ambulance service paid-by the Town on the basis of the assessment of each municipality bears to the total assessment of the four municipalities as equalized by the Counties Assessment Commissioner for each of the years 1967 and 1968. The applicable share of the subsidy assessed to each of the municipalities of Darlington, Clari =e and Newcastle for each year shall be paid in two instalments, the first on or before the 30th day of ,June and the second on or before the 31st day of December for the term of the agreement, to the Town. 4} The Town, Harlington Township, Clarke Township and the Village shall be responsible for payment for ambulance service for persons registered on the respective rolls of their welfare departments irregardless of where within the boundaries of the four municipalities, such person or persons shall require ambulance service. 5) The Town agrees at the end of each year, for the terra of the agreement; to apply to the Ontario Department of Health for whatever grants are available to assist municipalities with payments for ambulance service and a ree also to reimburse the Township of Darlington, the Toimship of Clarke, and the Village of Newcastle in the same proportion that t t 14�,r e beams to the total cost of providing ambulance service. 14, 7' IN WITNESS THEREOF the parties hereto have hereunto set their hand and seals.
