HomeMy WebLinkAbout68-9BY -LAY No. 68-9 A by -law for regulating the size and construction of culverts WHEREAS section 17a of the Municipal .pct, R. S .O. , 1960, chapter 249 authorizes municipalities to pass by -laws for prohibiting the obstruction of any drain or watercourse, and for permitting and regulating the size and mode of construction of culverts and bridges that cross any drain or watercourse situated on a highway under its jurisdiction. THEREFORE The Council of the Corporation of the Village of Newcastle enacts as follows: 1. All persons whose porperty fronts or abuts on any road or street in the Village, and who require an entrance to such road or street must apply to the Chairman of the Roads Committee for permission to construct this entrance. 2. Upon receiving any application the Roads Chairman will determine whether the entrance or driveway will obstruct a watercourse or drain and whether a culvert is required, and determine the diameter and type of culvert to be used,, and whether catch basins are required to facilitate the surface drainage of the roadway. 3. No person shall instal or allowed to culvert on a road in the Village without under this by -law and having secured the Chairman in writing. 4. The minimum size of culvert shall be 15 inches in diameter. be installed any having made application approval of the Road 20 feet in length by 5. No culvert other than that approved by the Road Chairman shall be used in the Village and not to restrict the generality of the foregoing but for purposes of clarification the require - ments shall be interpreted to preclude the use of boiler pipes, water main, wood plank, concrete block or any unsatisfactory material. - 2 - 6. Where a person has installed or allowed to be installed any culvert other than that approved by the Road Chairman then that person shall be notified of the condition and be requested to remove the culvert. Should the removal of any unsatisfactory culvert not be completed within ten days of receiving notice the culvert may be removed by the Village and the person shall pay the full cost of the removal. 7. Where a culvert has been installed in accordance with the provisions of this by-law the Village shall assume all future maintenance of such culvert. 8. Any person requiring an entrance culvert shall pay to the Village of Newcastle the cost of the culvert together with the cost of installation, and the cost of catch basins and their installation if required. 9. 'Where a culvert is, or appears to be required, the Building Inspector shall not issue a building permit until he has received a copy of the approval of the Road Chairman for the culvert. 10. Any person contravening any provision of this by-law shall, upon conviction, be liable to a penalty not exceeding $100. recoverable under the Summary Convictions Act.
