HomeMy WebLinkAbout68-14THE CORPOPLATION OF THE VILL4.GE OF NEWCA6TLE BY—LAw 68-14 a b­—law to allow Bell Telephone Co. of Canada to construct its lines of Telephone upon Public Property® Be it enacted by the Corporation of the Village of Newcastle as a By—law thereof as follows: lm That pursuant to the -orovisions of Section 378 (2) of the Railway Act, R.S.C. 1952, Chapter 234, the said Corporation hereby consents to the construction by the Bell Telephone Company of Canada of all its lines of telephone and telephone plant, heretofore constructed upon, along, across or under the streets, highways, squares, or other public places under the jurisdiction of the said Village of Newcastle in the locations and in the same manner in which the same have been constructed. 2® That -oursuant to the provisions of 6ection 378 (2) of the Railway Act, H.S.C. 1952, Chapter 234, the said Corporation hereby consents to the construction by the Bell Telephone Con -_any of Canada from time to time hereafter of all such lines of telephone and telephone plant as it requires for the purposes of its business upon, along, across or under any or all of the streets, highways, squares or other public places within the said Village of Ne-oTcastle and under the jurisdiction of this Corporation; -provided, however, that the construction of all such lines and plant by the Bell Telephone Company of Canada shall be done in accordance with the said Company's standards of construction from time to time in force and effect; ,)rovided fur--her that the location of all such telephone lines and -plant hereafter constructed or of existing lines and plant which may hereafter be relocated and the opening up of the streets, highways, squares or other public places for the erection of poles or for carrying the Com-nanys' wires underground shall be subject to the supervision of the Chairman of the Roads Committee of the Corporation of the Village of 'Hewcastle from time to time being, whose written approval of locations of lines and plant shall be valid and binding on the Cor-ooration. That upon obtaining the consent of the abutting landowners the Company may, with the approval and under the supervision of the said Chairman of the Roads Committee trim all trees growing or standing upon the streets, highways, squares or other public places of the Corpora Lion so as to keep its lines and wires from interference therewith. 4. That the Clerk of the said Cor-c,,oration is hereby authorized and directed to certify from time to time under the seal of the Corporation to the Bell Telephone Company of Canada the appointment and the name of the Corporation's Chairman of the Roads Committee authorized to act under this 3y-lai.�T. 5. And be it further enacted that in the event of the Council or other properly qualified body or person deeming it necessary to request the Company to move, alter or rearrange its line or lines of telephone and/or other -plant for the purpose of widening, improving or relocating a highway of the Corporation, or for any other purpose, the Chairman of the -Roads, Committee may give to the said Company an order to do such work as he deems necessary; and he may enter into an agreement with the said Company for the payment of the whole or any portion of the cost of the said work by the Corporation, and any such agreement entered into by the said Chairman of the _RLoads Committee shall be valid and fully binding upon the said Corporation, provided that the amount of the cost to be borne by the Corporation under the terms of the said agreement shall not exceed the sum of five hundred dollars (5500.) 6. That this By-law shall be effective from and including the date of its final -passing and shall remain in force up to and including December 31, 1971. HEAD A FIRST7 SELMNIDI A_ !
