BY -LAW 70 -8
Being a by -law to provide for the
licensing and registration of dogs
and for regulating the running at
large of animals.
WHEREAS Council deems it desirable to protect the
inhabitants and animals in the Village of Newcastle against the
infection of rabies and to provide for the licensing and registration
of dogs and for imposing a license fee on the owners thereof and
generally for the regulating of the running at large of animals;
NOW THEREFORE the Council of the Corporation of the
Village of Newcastle pursuant to the authority provided by Section
379 (1) of The Municipal Act R.S.O. 1960 Chapter 249 and Sections
5 and 6 of the Dog Tax and Cattle, Sheep and Poultry Protection
Act, R.S.O. ]960, Chapter 111, renamed the Dog Tax and Live Stock
and Poultry Protection Act and amended by 1965 Chapter 33, hereby
ENACTS AS FOLLOWS:
1. In this By -law
M"animal" means any dog or cat
' °dogn means any dog, male or female
(c) "cat:" means any cat, male or female
(d) "owner" of a dog includes any person who possesses or
harbours a dog and "owns" and "owned" have a corresponding
meaning
(e) "running at large" - an animal shall be deemed to be
running at large when found in a highway or other public
place and not under the control of any person by means of
a leash not more than ten (10) feet in length.
(f) "spayed female" means a female dog which has been
operated on by a licenced veterinarian to prevent
conception.
2. The owner of every dog in the Village of Newcastle shall on or
before the fifteenth day of February in each year pay to the
Village of Newcastle a license fee in accordance with the
following schedule:
(a) licence fee for male dog, if only one is kept - 2.00
licence fee for one additional male dog - 6.00
(b) licence fee for a female dog, if only one is kept- ;x.00
licence fee for one additional female dog - $10.00
(c) where a certificate in writing by a veterinarian
is produced showing that a female dog has been
spayed, it shall be licensed at the same rate as
a male dog.
(d) the licence fee shall be paid at the office of the
Clerk and at such other places as shall be determined
by the Clerk.
3. Dogs shall be registered by their owners on or before the 15th
day of February in each year on registration forms provided for
the purpose.
(a) Dog owners shall provide the following information:
(1) the name and address of the owner of the dog;
(2) name and description of the dog to be licenced;
(3) such further or other information as may be required
by the Clerk of the Village of Newcastle.

(b) The issuer of licences, upon payment of the proper licence
fee, shall issue to the owner of every dog a tag having
inscribed upon it a serial number and the year for which
it was issued and the said issuer of licences shall also
issue to the owner of a dog so licenced, a receipt for the
licence fee so paid and the licence shall expire on the
thirty-first day of December of the year for -which it was
issued.
(c) The licence fee paid pursuant to Section 2 shall be applied
only in respect to the dog licence for which the said fee
was paid and shall not be transferable, nor shall the dog
tag issued for a dog be used for or affixed to the collar
of any dog other than the dog for which it was issued.
(d) Every person who becomes the owner of a dog after the 15th
day of February in each year shall register the same and
pay the licence fee therefore as provided in Section 2,
within fifteen days after becoming the owner of the said
dog.
No person shall operate a kennel within the limit of the
Village of Newcastle.
(f) No one family dwelling shall keep or maintain more than
2 dogs within the Village of Newcastle.
In multiple family dwellings no family shall keep more
than 1 dog in the Village of Newcastle.
(g) The owner of a dog which has been duly licenced and registered
under this by-law may obtain a dog tag to replace a dog tag
which has been lost, upon payment of a fee of 25 cents.
4. No animal shall run at large and no person whall permit an
animal owned or harboured by him to run at large in the Village
of Newcastle.
5. No person shall keep or maintain any dog in the Village of
Newcastle unless such dog has been licenced and registered under
this by-law and subject to the provisions of the Dog Tax and
Live Stock and Poultry Protection Act wears a collar to which
is affixed a dog tag issued for the current year for the said
dog.
6. No person shall allow his dog to become a nuisance nor permit
it to howl or bark excessively. Any person so aggrieved may
appear before a Justice of the Peace and swear out an Information
on charging the owner with a breach of this section.
7. Any person shall be entitled to take charge of any animal found
running at large and deliver the same to the Animal Control
Officer for the Village of Newcastle.
8. Any animal found running at large may be lodged in the animal
pound and shall be fed and watered for a period of not less
than seventy-two (72) hours plus days that the pound is closed,
and if not redeemed a-Ili the expiration of 72 hours plus days
that the pound is closed; may be sold or destroyed.
9. The Animal Control Officer of the Village of Newcastle shall
within twenty-four (24) hours from the seizure of any dog
bearing a tag, or within twenty-four (24) hours from the time
any dog bearing a tag is taken into the animal pound, when
possible, notify the owner of the seizure with the exception
of Sundays.
10. The owner of an impounded dog shall be entitled, on proof of
ownership, to regain possession of the animal on application
to the animal pound and payment of a pound fee of $2.00 for
each day or part thereof that the said animal has been impounded.

11. The fee for picking up an animal at the request of the owner
and disposing of, or selling same through the services of the
Animal Control Officer shall be $1.00.
12. Animals that have been destroyed at the end of the seventy-
two (72) hours period shall be destroyed or disposed of in
such manner as Council may from time to time by resolution
direct.
13. No dog shall be returned to the owner unless it has been
licenced in accordance with the provisions of this by-law,
and any owner of a dog without a tag and any purchaser of
a dog shall obtain a tag for the current year before delivery
is made.
14. A penalty of not more than Fifty Dollars ($50.00) exclusive
of costs shall be imposed upon every person who contravenes
any of the.provisions of this by-law and every such penalty
shall be recoverable under the provisions of the Summary
Convictions Act.
15. This by-law shall become effective as of the lst day of July,
1970.
16. From and after the effective date of this by-law, By-laws No.
711, 789, and 68-12 and all other by-laws at variances to this
by-law are hereby repealed.
