BY -LAW NO. - "
Being a by -law to confirm the sale
of lands to Penwest Development_...
Corporation Limited for the
establishment of industry and
amend by -law 73 -36.
WHEREAS by by -law Number 73 -36 passed on the 25th day of
June, 1973, the Corporation of the Town of Bowmanville, hereinafter
called the "Town" agreed to sell the lands therein described in
Schedule "A1° to Penwest Development Corporation Limited, hereinafter
called "Per-west", for the purpose of the establishment of industry
and also by the said by -law further agreed to grant to Penwest an
option to purchase certain lands described therein in Schedule "B ".
AND WHEREAS a survey of the lands being sold and optioned
has revealed the advisability of providing for a widening of the
travelled road running along the eastern /limiter of the lands being
sold and optioned. and southern
AND WHEREAS Penwest has agreed to the resulting decrease
in the acreage being purchased and it is necessary to confirm certain
changes in the agreement of purchase and sale as set out and confirmed
in by -law number 73 -36.
NOW THEREFORE the Council of the Corporation of the Town of
Bowmanville in consideration of the premises and pursuant to the
Municipal Act R.S.O. 1970, Chapter 284, Section 354 (1), paragraph
50, HEREBY ENACTS that by -haw number 73 -36 be amended as follows:
1. That Schedule "A" be deleted and Schedule "A" to this by -law
be inserted in the place instead thereof.
2. That Schedule "B" be deleted and Schedule "B" to this by -law be
inserted in the place instead thereof.
3. That paragraph 1 of by -law 73 -36 be amended to provide for the
sale and conveyance of 3.211 acres at a price of $22,477.00
rather than 3.54 acres at a price of $24,780.00.
4. That paragraph 2 of sail by -law 73 -36 be deleted and following
substituted therefore:
"that the said purchase and sale shall be completed
within one month after the passing of the by -law"
5. That paragraph 3 of said by -law 73 -36 be amended by changing
the acreage and purchase price to 7.010 acres at $49,070.00
from 7.15 acres at a price of $50,050.00.

6. In all other respects the said by -law 73 -36 be and the same is
hereby confirmed.
7. That the terms "Town°, "Town of Bowmanville" and "The Corporation
of the Town of Bowmanville" when used in the said by -law no.
73 -36 and this by -law and as required shall refer to The
Corporation of the Town of Newcastle, the successor municipal
corporation to the Corporation of the Town of Bowmanville.

SCHEDULE `° A "
ALL AND SINGULAR that certain parcel or tract of land and p3mises
situate, lying and being in the Town of Bowmanville, County of
Durham and Province of'Ontario and being composed of part of
original Township Lot 8 in the lst Concession of the Township
of Darlington now within the limits of the said Town of Bowmanville
containing by admeasurement 3.211 acres more or less and being
more particularly designated as Part 15 as shown on Reference Plan
1OR 269 deposited in the Registry Office for the Registry Division
of Durham West (No. 10) on the 23rd day of November, 1973;
TOGETHER WITH a right -of -way for persons and vehicles over Parts
20 and 22 as shown on said Reference Plan 1OR 269 until such time
as the said parts 20 and 22 are dedicated and accepted by the
Corporation of the Town of Bowmanville or its successor municipal
corporation as public highways;
SUBEJECT TO an easement in favour of the Hydro Electric Power
Commission of Ontario registered as instrument number 8651 over
Part 20 as shown on said Reference Plan 1OR 269.

SCHEDULE "B"
ALL AND SINGULAR that certain parcel or tract of land and premises
situate, lying and being in the Town of Bowmanville, County of
Durham, and Province Of Ontario and being composed of part of
original Township Lot 8 in the lst Concession of the Township
of Darlington now within the limits of the said Town of Bowmanville
containing by admeasurement 7.01 acres more or less and being
more particularly designated as Parts 13 and 14 as shown on Reference
Plan 1OR 269 deposited in the Registry Office for the Registry
Division of Durham West ( No. 10) on the 23rd day of November,
1973;
TOGETHER WITH a right -of -way for persons and vehicles over Part,,'
SAm 22 as shown on said Reference Plan 1OR 269 until such time
as the said Parts 20 and 22 are dedicated and accepted by the
Corporation of the Town of Bowmanville or its successor municipal
corporation as public highways.
This is Schedule "B" to By -Law 5. passed on the 28th day of
December, 1973.
